The woman moved to another room for a better view, then called her husband. The pair watched Clark for up to 15 minutes from the privacy of their darkened bedroom.

The court found they took care to avoid being seen by Clark, peering out from underneath their partially lowered blinds. Later, the woman's husband fetched a pair of binoculars and a telescope. He also tried, unsuccessfully, to videotape Clark in action, says the judgment.
They went to great length to get a good view of him anyway. Strange people.

I want to know how someone can prove you were illegally jerking off in your own home. Are they allowed to use binoculars to look into your home or peek into your windows?

Considering it's Nanaimo it does not surprise me to see the couples, eventual, reaction.

As much as I hate to say it, Axis Kast does have a point. How could the prosecution spin the invasion of privacy so effectively as to completely ignore that the couple tried to videotape the act before they even though of the children. I'd also like to know why they would try to videotape it if they were so concerned about their children.

A reasonable person would have policed his kids, i.e. closed the blinds and not make a big deal out of it and then would have let the neighbour know that his actions were visible. The guy would have probably been embarrassed enough that he would have been more careful the next time.

Well, I do think that while one shouldn't be letting others see what is going on at that time... come on, binoculars and a telescope?!?! Psychos I would say. I'd probably move if I were the guy just to get away from such creepy ass neighbors.
