Quick first impression: the Republikans pretty much know a Democrat is going to win in 2008 and suddenly the idea of a Democrat (say, Hillary) having Patriot Act powers at his/her disposal is A. Bad. Thing.

So they have to change the herd's direction and fast.

To be fair, Napolotano has been, to my knowledge, libertarianish for a long time, and they've always hated the patriot act.

He did seem to rather enjoy emphasizing that our rights in the constitution were "God Given". Maybe he was going for an ad nauseum approach, if he said it enough people might believe it. etc.
