i don't think the sensitivity of the info matters as much as the fact that you're actively betraying your country in a time of war. however in peace time it could be dependent upon the sensitivity of the information leaked to other countries. i'm not 100% positive on the law concerning this however.

The sensitivity of the information, it's usefullness to the enemy, and the potential use of the traitor all matter.

Our men and women are still coming under regular attack, we still have military operation ongoing, and we haven't come close to seriously pacificying things. Whatever semantics the Commander in Cheif wants to apply that's pretty much a war.
And of course Al-queda hasn't surrendered and we've by no means wiped them out so I'd say the War on Terror is ongoing.
