The only ground breaking thing about this is SCOTUS is going to torpedo this decision so fast the idiot judges are going to get wiplash. They just ruled against the 4th amendment and they have ZERO grounds to do that.

Someone hasn't been to Louisiana. Even if the Metropolis you will still find overwieght Fundie pricks making laws.

This is Shit. I think I'm suddenly as interested in moving to Alaska as David is. I hope I can take my dad...
The Constitution of the United states of America wrote: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
You're not taking this one! You take one, you'll have them all in no time whatso-fucking-ever, you Gods Damned Anti-American Asshole Gestapo Swine!

FYI: The New Orleans Police Department is by a hefty margin the most corrupt and abusive police force I've ever encountered or much less heard of. Here it's common practice to refer to them as 'Legalized Mafia Thugs'. They've just recently nearly killed (via gangland-style beatings) several of my friends with absolute impunity and with no chance of defense, legal or otherwise, just on the spur of the moment.

If one (one? more like him and ten of his cheery buddies) of these porcine Gamorrean meatheads comes after you, I very strongly urge you to A: get a good lawyer, and B: High-tail it to Mexico. I'm not very friendly towards breaking the law (Most of them are there for a good reason), but these assholes aren't at all interested in not trying to beat you half to death, much less a little thing as actually following the law...

And I'm kinda wondering if these pigs wouldn't love to get a chance at enacting a sedition law too. Where's the Feds when ya need 'em?

Come live in Australia. You can smoke so much weed it isn't funny, march in the Gay Mardi Gras, and play Quake in one of our many LAN places.

Plus there is plenty of work available.

Despite the fact that this ruling will probably get overruled, this is one of the reasons that I will never ever return to Louisiana of my own free will.

*resists urge to go to Louisiana and firebomb the 5th circuit court of appeals*

I hope that this is appealed to the supreme court. They will take up this case... If they dont, justice is dead. How the fuck could they rule like that. The constitution clearly states that you MUST have a warrant. Unlike the first amendment there is NO maneuvering room in it.

*Somebody* is going to backlash against this...

And I hope it is soon. I don't want to see this spread to other states (seeing as I am in Texas)

And no, I wont be visiting Louisiana anytime soon...

i fail to see how this law was allowed. . . .this practically takes a shit on one of the constitution's simplest rights. hopefully the supreme court gets wind of it soon.

Anyone have any idea how this goes beyond the "probable cause" search?

The article doesn't say much but it does make it sound like the officer can be a bit more vague in a wider range of circumstaces and still legallt perform a search that in the past he would have needed a warrant or a situation where it seemed clear that someone was in danger.

The way the article words it, it makes all instances proabable cause allowing the officer to search whenever they arrive and have a legitimate problem. However, since all the checks on this power are subjective, the police can essentially do whatever they want.

Why don't they just get rid of the court system then, since the police are being given powers of discretion traditionally accorded to the court system? We can just put it all in the hands of this man:

I'd rather go with Judge Anderson. She seems to be a bit more reasonable, of course being a telepath probably helps determine whether people really are guilty. :D
