When U.S. Immigration and Customs Enforcement agents arrived at a Nashville home Monday in an attempt to detain a man there, neighbors and activists gathered to support the man, who remained shuttered in a van with a child for hours before the agents left.

And once the agents and police officers they had called to the scene finally drove away, neighbors who had kept the man and the boy fed, hydrated and cool, formed a human chain from the van to the house as the man and the boy shuffled inside.

"It was striking to watch neighbors deliver food, water, and gasoline to help their neighbor stay in his car," Nashville Councilman Bob Mendes, who witnessed part of the incident, wrote in a statement. "Having watched this play out, I have a new appreciation for the practical difficulty cities face in dealing with ICE civil immigration enforcement."

The ICE agents attempted to stop the white van in Hermitage early Monday morning, but when the driver would not stop, they followed him to a home, according to a statement from the Metropolitan Nashville Police Department.

The agents, driving unmarked vehicles, blocked the van in the driveway, catching the attention of neighbors, according to a statement from the Tennessee Immigrant & Refugee Rights Coalition (TIRRC), whose staffers responded to the incident.

Police, who reported to the scene after the ICE agents called them, reported that the man, who has not been identified, had a 12-year-old child with him in the van.

TIRRC said that the agents and Metropolitan Nashville police officers remained at the scene for several hours.

The neighbors who lent their assistance "reported that they were worried and outraged because some had known the family for more than a decade," the TIRRC statement said.

Several people recorded and live-streamed the incident on social media.

"They told local media outlets that ICE 'picked the wrong community on the wrong day,'" the statement said. "What happened this morning shows how deeply rooted immigrants are in our community."

TIRRC's statement said the ICE agents had "no judicial or criminal warrant to apprehend" the man, who was within his rights to remain in the van.

"ICE doesn’t have the authority to enter your home or private property without a warrant signed by a judge," the TIRRC statement said. "The majority of the time, ICE only has an administrative warrant — not a judicial one."

TIRRC questioned why police officers responded to the scene. "When immigrant community members and their families associate local police with federal immigration enforcement, they are less likely to report being a victim or a witness to a crime — making the whole community less safe," their statement said.

Mendes said that he saw two marked police cars at the scene, and he was told a detective in an unmarked vehicle arrived during the hour he was there. Officers had their blue vehicle lights on shortly after arriving and then turned them off.

Mendes said he saw brief conversations between the officers and the ICE agents.

One officer told him "there were no known criminal warrants for the man in the van." The officer said that police were there "to protect the public, the people in the van, and the ICE agents if necessary," but otherwise, "would have no role."

"The officers were instructed to not be involved in the service of the detainer, but to stand by from a distance to keep the peace if necessary," said a statement from Metropolitan Nashville Police Department spokesman, Don Aaron.

"Our police officers do not actively participate in immigration enforcement efforts and only serve as peacekeepers," Nashville Mayor David Briley reiterated in a statement, according to NBC affiliate WSMV.

"I am keenly aware that this type of activity by our federal government stokes fear and distrust in our most vulnerable communities, which is why we do not use our local resources to enforce ICE orders," Briley said.

A statement from ICE said the agents were at the Nashville home Monday "seeking a convicted criminal alien ICE fugitive with an outstanding removal order ... when they were encountered by a small group of protestors."

"Out of an abundance of caution for the safety of all persons involved, ICE personnel subsequently made the decision to depart without making an arrest to deescalate the situation," the statement said.

ICE's southern region communication director, Bryan D. Cox, added that anyone who interferes or obstructs federal law enforcement officers can face criminal charges.

And people who are "ordered removed from the U.S. who willfully fail to depart" can also face criminal charges along with fines up to $5,000.

Last week, the Trump administration began immigration raids as part of an operation expected to target 2,000 immigrants, but it's unclear if this situation was related to that effort. So far, 35 individuals have been detained as a result of the raids, ICE Acting Director Matthew Albence said during a news teleconference Tuesday. In a separate operation, carried out between May and July, 899 people were arrested by ICE.

Targets 2,000, has only arrested 35. That's probably at least partly due to the failure of communities to cooperate, and to Democratic politicians and activists making sure people know what their rights are.

Another example of alert citizens successfully standing up to ICE thugs: Individuals identified as ICE agents tried to raid a homeless shelter in New York. They falsely claimed to have a warrant. The shelter's security demanded a warrant, which they refused to provide. Finally, they were forced to back off. ICE then had the nerve to deny that the raid ever occurred.

Immigration and Customs Enforcement agents tried to enter a Brooklyn homeless shelter Tuesday night but were turned away after failing to produce a warrant, said Christine Quinn, the shelter network’s director.

The agents came to the East New York WIN shelter around 10 p.m. and showed guards a photo of someone they were seeking to detain, she said.

The ICE agents said they had a warrant. When asked to display it, they balked, and WIN guards denied them entry.

“They showed nothing except for a picture of an individual,” Quinn said. “The guards kept saying, ‘Show us a warrant signed by a judge.’ They wouldn’t show a warrant.”

ICE spokeswoman Rachael Yong Yow denied that ICE sent an enforcement team to the shelter.

But WIN’s head of security said he was talking to the shelter’s guards during the standoff and that eight people wearing ICE insignia who identified themselves as agents were in fact there.

If a warrant had been produced, shelter guards would have then been required to send a picture or scan of it to lawyers with the city Department of Homeless Services. If DHS deemed it up to snuff, the guards would have then presumably provided access to the facility.

Staff on Wednesday declined to discuss the night raid.

“We can’t talk about it,” one guard said upon leaving the high-rise shelter.

“It’s good they didn’t let them in," said one of the facility’s residents.

But Quinn questioned whether this was strictly about access or more about instilling fear among the city’s homeless and immigrant populations. She pointed to President Trump’s announcements of ICE raids in big cities that never actually came to fruition, but led to heightened anxieties.

“Our most basic job at WIN is keeping our clients safe,” she said. “That means keeping them safe from abusers, that means keeping them safe from neighborhood factors and that means keeping them safe from the biggest bully of all — the president of the United States.”

ICE spokeswoman Yow noted that “ICE officers conduct enforcement actions on a daily basis, and we continue to abide by our sensitive locations policy.”

“Due to law-enforcement sensitivities and the safety and security of U.S. Immigration and Customs Enforcement personnel, the agency will not offer specific details related to enforcement operations," she said.

In New York City, the director of a Brooklyn homeless shelter says she turned ICE agents away Tuesday night after they failed to produce a warrant. Last month, widespread mass raids by immigration agents did not materialize as immigrants rights advocacy groups across the country urged people not to open their doors to ICE agents unless they produce a warrant. The ICE agents who came to the Brooklyn homeless shelter just had a photo of a person.
