An academic in South Africa has cast doubt on Elon Musk's defence that the term "pedo guy" is a common insult in Pretoria and therefore not defamatory, ahead of tomorrow's hearing and his legal counsel doubling-down on the stance to the ABC.

A Los Angeles court will decide tomorrow (7:30am AEDT) whether to go ahead with a defamation case against Mr Musk, brought by British caver Vernon Unsworth, who played a key role in last year's Thai cave rescue operation.

In a television interview, Mr Unsworth suggested Mr Musk's offer to provide a submersible rescue pod was grandstanding and said Mr Musk "can stick his submarine where it hurts".

The founder of Tesla and SpaceX took to Twitter in response, ending a volley of angry tweets with "sorry pedo guy, you really did ask for it" — he later apologised and deleted the tweets.

Mr Unsworth sued two months later in a Los Angeles federal court, saying Mr Musk falsely branded him a paedophile and child rapist.

Mr Musk has not provided any evidence to back his allegation and is instead arguing that he relied on information provided by a private investigator which he did not know to be false at the time and did not intend to publicly brand Mr Unsworth a paedophile.

Mr Unsworth has strongly denied any accusation of paedophilia and has sued for defamation, looking for $111,000 in damages.

However, Mr Musk is trying to have the case thrown out before trial on several legal grounds.

"Mr Musk testified that 'pedo guy' was a common insult used in South Africa during his youth," wrote Mr Musk's attorneys, in court documents.

"It is synonymous with 'creepy old man' and aimed at mocking a person's appearance and demeanour, not an accusation of paedophilia," the attorneys wrote.

The ABC contacted several linguists from universities in Pretoria — where Mr Musk lived until he was 17 years old — to check the claim.

Most did not feel appropriately qualified to address the issue, but Molly Brown, the head of the Department of English at the University of Pretoria, said the term was not well known.

"I think I can confirm that 'pedo-guy' is not a commonly used insult in South Africa," she told the ABC.

"A quick look at the local twitter sphere confirms this … the only tweets I can find in support of Mr Musk's assertion come from men who attended his school," she said.

"This might mean that the term was current in his particular school environment."

"I also think that just as most of us would rather die than dress as we did at school, so the average person abandons school slang as a means of public communication within a surprisingly short time after leaving school behind."

Musk spends tens of thousands on private investigator

In a statement to the ABC, Alex Spiro, one of the lawyers representing Mr Musk, doubled down on the supportive tweets as evidence that "the term or insult 'pedo guy' was commonly used in Mr Musk's school in South Africa".

"Mr Musk deleted the tweet and apologised," he said.

While part of the legal appeal seems to try to distance Mr Musk from the paedophile allegation.

Mr Musk spent more than $US50,000 ($74,000) on a private investigator, who offered his services to "dig deep" into Mr Unsworth's past.

The investigator travelled to Thailand and sent back reports with unverified claims, which Mr Musk appears to have taken as fact.

"The investigator reported that Mr Unsworth was a fixture in Pattaya Beach, Thailand — a locale notorious for prostitution and child trafficking, that he had a taste for young Thai girls," wrote Mr Musk's attorneys in the court documents.

The attorneys wrote that according to the investigator: "He whore-mongered his way through the go-go bars of Thailand, that his only friends were his 'sexpat' peers, and that he married his Thai wife when she was a teenager, after starting a relationship when she was a young girl."

Again, no evidence was presented to Mr Musk, or to the court in the recent documents.

Cave diving is perilous at the best of times but finding and freeing the 12 Thai boys and their football coach from Tham Luang posed extreme challenges.
In their response to the court, Mr Unsworth's lawyers say that, contrary to the investigator's reports, he met his wife in London in 2011 when she was 32 years old and he only made his first trip to Thailand to visit her in 2018.

"Like the bully that he is, Musk chose to lash out publicly at the criticism only by falsely attacking Unsworth, a relatively unknown individual, and publicly challenging him to sue for libel," Mr Unsworth's attorney Lin Wood wrote.

"Musk's motion is based principally on the antithetical bases that, on the one hand, he was not calling Unsworth a paedophile, while on the other hand, he did not harbour serious doubts as to whether Unsworth was actually a paedophile."

Based on these verbal reports from the so-called investigator, Mr Musk emailed comments to a BuzzFeed News reporter that were meant to be off the record, referring to Mr Unsworth as a "child rapist".

Mr Musk's lawyers are now arguing the billionaire should not be held liable for his comments because he did not believe them to be false.

"Because Mr Musk based this tweet on information concerning which he did not have serious doubts, Mr Unsworth cannot establish it was written with actual malice," wrote Mr Musk's attorneys.

"Although it turns out that the investigator lacked solid evidence of Mr Unsworth's behaviour, that does not matter here."

In their response to the court, Mr Unsworth's lawyers say Mr Musk did not vet the investigator, James Howard-Higgins, for reliability and say Mr Musk himself now acknowledges that Mr Howard-Higgins was a "con man … just taking us for a ride".

The defamation case against Mr Musk has been set for December 2.
So can I call someone a terrorist without fear of defaming them, on the grounds that its slang around a small group of friends who will never ever deny otherwise. :D

Heard about it. The man is a billionaire and he's so fucking stupid that he is at risk of losing a defamation lawsuit, in America.

I have been a little curious whether there's anything to the 'it was common South African slang' thing, but given he was apparently simultaneously hiring a private investigator to look into the guy on the off-chance he actually was a pedophile when he said it...

Australian broadcasting corporation claimed they asked various linguists in SA and it was telling that most didn't feel confident to address it, and the only one who did it said it was unlikely.

To elaborate, the worst case scenario financial judgments against Musk in this case may be negligible, but face, reputation and public good will are things that have hard to quantify value to him and losing them can harm him. We are, after all, experiencing an upsurge of ill-will towards the wealthy and you never know what will provide the extra oomph to that that ends up fucking them over.

And this sort of thing is part of a pattern of behavior for him, like mocking regulatory agencies and such on Twitter while they are investigating him and causing his company's stocks to drop in real time.

He is already on the SEC's radar for his attempt at manipulation of the Tesla stock price, and the International Telecommunications Union (ITU) for functionally flooding the new satellite approval process while not being responsive to concerns from existing satellite operators (Starlink is supposed to be both an income stream, and ensured launch demand as the market slows soon).

Elon Musk did not defame a British cave diver when he called him “pedo guy” in an angry tweet, a Los Angeles jury found on Friday.
Vernon Unsworth, who took part in the rescue of 12 boys and their soccer coach trapped for weeks in a Thailand cave last year, had angered the Tesla CEO by belittling his effort to help with the rescue as a “PR stunt”.

Musk said the attack was unprovoked and he only meant the term as an insult for “creepy old man” and was not literally calling Unsworth a paedophile.

Unsworth’s lawyer suggested to a federal jury Friday that it award US$190 million in damages to a British cave explorer who is suing Elon Musk for allegedly branding him as a paedophile during a Twitter spat.

Lawyer Lin Wood said the suggested award would include US$150 million as a “hard slap on the wrist” to punish Tesla CEO for what he said was akin to dropping an atomic weapon on his client.

“What in the world would it take to discourage Elon Musk from ever planting a nuclear bomb in the life of another person?” Wood said.

Musk, who testified his stock in Tesla and SpaceX is worth about US$20 billion, contends that he was not literally calling Vernon Unsworth a paedophile when he referred to him as “pedo guy” on Twitter.

Musk’s lawyer told the jury the tweet was an insult provoked by Unsworth and did not rise to the level of defamation. Lawyer Alex Spiro said Unsworth also failed to show actual damages.

A jury of five women and three men deliberated for less than an hour in the afternoon in US District Court.

Unsworth had ridiculed Musk’s effort to help in the rescue by having engineers at his companies, including Space X and The Boring, develop a mini-submarine to transport the boys. Despite working around the clock to build the sub, Musk arrived in Thailand late in the rescue effort and the craft was never used.

Unsworth called it nothing more than a “PR stunt” and said Musk could stick the sub “where it hurts”.
In his closing argument, Wood called Musk a “billionaire bully” who lied when he claimed “pedo guy” only means “creepy old man” and said his apologies to Unsworth were insincere.

“When Elon Musk tweets something it goes around the world,” Wood said. “It can never be deleted.”

Unsworth testified that he had to sue Musk for defamation because if he did not, the allegation would seem true.
In his testimony, Musk insisted that the phrase he tweeted off-the-cuff “was obviously a flippant insult, and no one interpreted it to mean paedophile”.

Spiro mocked Unsworth’s claims that he had been shamed and humiliated and that the tweet effectively sentenced him to a life sentence without parole.
Spiro noted that Unsworth had been honoured by the queen of England and the king of Thailand, had his photo taken next to British Prime Minister Theresa May and been asked to speak at schools and contribute to a children’s book, which showed that no one took Musk’s insult seriously.

“People accused of paedophilia don’t get celebrated by world leaders,” Spiro said. “Kings and queens and prime ministers don’t stand next to paedophiles.”

As someone neatly explained elsewhere...
If your in a crowd (twitter) and you shout that guy's a pedo and everyone jumps they guy and beats him up you have caused defamation since your words caused him hurt. Likewise if his boss fired him, everyone turned their back on him ect.

But if your in a crowd and you shout that guy's a pedo and the crowd beats up YOU, then your defamation free since that guy suffered no damages. In American defamation requires damage which Vernon Unsworth lawyers failed to demonstrate. Helpfully Elon's lawyers had plenty of materials showing how Elon had been attacked for his comments and Vernon Unsworth had been defended.

And lets be clear Vernon Unsworth should not have been called a pedophile by Elon Musk but considering we don't punish US Representatives sending death threats towards Representative Ilhan Omar I expected as much.

But apparently princes do.

Regardless of the legal rights and wrongs, this verdict still sends out the message that it's ok to call someone a paedophile on Twitter.
