Where will he be judged?

Post by Colonel Olrik »

Well, let's avoid passionate opinions and examine the advantages and disadvantages of each situation, and what the likely outcome will be.

Iraq, most definitely. There's no way in hell he's going to an international court, and we won't try him in the U.S., for sure.

If they don't try him in iraq then the problems will be worse, let the iraqi's get their revenge, its not the place of the rest of the world to do it for them.

Will, I presume. Though I think that the Iraqis deserve to have him tried there.

But Iraq haven't had a just court for decades (if ever). It will be a very long time before a just legal system is in place (and with no visible western influence). Besides, many of Saddam's crimes are international, not only local, and he should be judged for those too.

Where. Unless he kills himself and saves us the trouble (which won't happen, he's not that type of man), I don't think there's any other option than to trial him. He's too well known to be sent somewhere to rot.

Uh, if anything, western influence is likely to make the punishment Saddam will receive from an Iraqi war crimes tribunal less harsh.

I think holding him in some shithole of his own creation until there's an Iraqi justice system up and running would suit everyone just fine.

He probably victimised more Iraqis than anyone else, they deserve to try him.

In any case, allowing Iraqis to try the man who oppressed and slaughtered them for years would be a great way of starting to hand power back to the Iraqis. More so than sending him to some candy-ass International Court.

You misread. Are you asking WHERE WILL he be judged or WHERE SHOULD he be judged?

Will. But I guess you can argue both.

Will = Iraq
Should = some international tribunal

There is no way in hell he'll ever get a fair trial in Iraq, but as this is Saddam himself we are talking about I don't really care it's just the princible of it.

Of course he will get a fair trial in Iraq. How the hell can he attempt to justify or excuse what he has done? The crimes were mostly done in Iraq, try him there.

If after his trial in Iraq, other countries or compaintents want to extradite his ass (assuming that he isn't beheaded by then) then let them. The absolute last place he should go, though is the ICC.

With all the political mess the will follow the case, being in the ICC will just magnify it. IMNSHO.

Since his connection to Al-Faede is bassically support for the PLO (which many americans and most of our allies in the region do too), the fact that the WMD evidence has not been found, and what existed was staged and manufactured by the US government. Since technically we broke international law. This is going to be handeled in the US as the US really does not want to awknowledge that they created Saddam, and were aware of his activities, just as the US does not want to awknowledge our relationship with Noriega prior to our invasion of Panama. Or our relationship with deathsquads in south america, and hundreds of other dirty deeds done dirt cheap..

The united states definatly does not want revealed that curtesy of our anti soviet activities in the 1980's, and Pat Robertson's involvement in Conflict Diamonds, and the Number of US Citizens that Support Terrorism against england and japan. That the United states government has MORE ties to OBL then Saddam did.

International court...

With both Milosevic and Saddam on trial there it would certainly gain a great deal of legitimacy.

IMHO he should be tried in Iraq, then if for some incredible reason they don't kill him, he goes to the ICC, then serves the sentances consecutively.

I expect him to stay in Iraq, though.

Wrap him up and ship him to Iran. I'm sure they'd enjoy a mother of all Christmas presents.

I say we let the fucker burn in Iraq and let him taste the fruits of his own creations. We've already had plenty of evidence that he's a bloodthirsty bastard, he's flaunted it for decades, so any trial will be merely a show, no matter where it takes place, and the last thing I want is some Belgium judge letting him off.

Why do you think that?
Because the ICC is a political construct, in my opinion. Too many factions that will use the proceedings to further their own agendas weather it is the US or the EU or another enity. Too many fingers in the pie, sort of speak.

To be honest, there might not BE ANYWHERE fair to put Saddam on trial. Anywhere that the US and Iraq might think is fair, would be techniquely unfair to Saddam from a purely legalistic viewpoint. But putting it into an actual international arena increases the factions, interest groups, and rivals that will participate.

A trial in Iraq would limit the political circus to those that are in Iraq now to include the Iraqi's. And as I mentioned before, I think that anyone that wants his carcass after he's tried and convicted in Iraq, can ask for him to extradited.

We're already in the process of arranging for trials in Iraq so it'll most likely be held there.
