WH40k Copyright Question

I am currently writing a program that serves the same purpose as ArmyBuilder. IOW, it allows you to select units and options from a specfied army and compiles them into an easily readable list. Keeping in mind that I have never actually seen ArmyBuilder, and therefore limit my chances of copying elements of the program, and do not plan to sell the program, is it legal for me to continue making this program? My permanent residence is in GA, if that affects anything.

I don't think so. I believe that is under fair use laws isn't it?
