abandonware vs. warez

Dear G&C mods,

Faram (et al.), can a clarification be made for the differences here? I may just be ignorant, but I do not understand what is so bad about advertising abandonware. I thought that even on the "dog site", does it not list the law that shows how they are able to offer the games listed? And with some of the games, they even list an old game but state you MUST purchase it from the original company, or somesuch, or Purchase the game from digitalbits.

Because in a strictly legal (as in being potentially sued) abandonware does count as warez.

I did not make the copyright law.
But isn't abandonware illegal?

Unfortunately, yes. Despite the fact that publishers no longer derive revenues from these games since they have stopped selling them (and any revenues from retailers that still sell them were gained a long time ago, at the time of sales), it is illegal to distribute them so long as copyright holders have not released them into the public domain, and 95 years after the games' release have not elapsed.
So just because it is abandoned do not mean that the are legal, so I will as long as an admin do not tell me otervise kill links to abandonware sites.

I fully support abandonwares sites like "The Underdogs" who clearly display when a game is available for purchase, even when through very obscure means. And when it is available for purchase, they don't have it available for download...

That is what makes it good for me...

I agree with weemadando on that one. It was that site that got me to purchase a copy of MoO2 rather than download it off that K-named P2P service, since I saw the rights had been bought and it was being remanufactured. They'll only make a game available if it's not available otherwise (or soon to be made available...I'm pretty sure they've pulled games when a company announced plans to re-release).
