regardless of the status of the pilot the Dragoon they shot seems to have been damaged previously as it was draging it's left rear foot (the one closer to the "camera") and there were sparks coming of said foot.
as for Arbiter's cloak tbh I assume it's unable to cloak itself during game play for balance reasons (so that Protoss cloak wouldn't be a total game breaker).

The way the cloak on the Arbiter works game mechanics wise is that it has a region surrounding it that cloaks all eligible units beneath it. Guess what unit is the highest-flying? The Arbiter, which is the only one that can fly over the field, and thus is not cloaked by it.
