Oh, and before I forget, as of 2-20-2003, I have begun to receive tons of SPAM from an e-mail address titled:

spam@kinghell.com

-- an e-mail service that is provided by http://www.kinghell.com which is owned and operated by the SAME company that hosts the DracoAlliance's website.

I am not making any accusations here, but this does seem very suspicious.

If anyone has any information about this - as Spam is illegal and so is signing people up for it - please contact me via e-mail.

I would polietly ask him for the password to that site. So that you may ensure that your material is no longer present on their website. If he has nothing to hide then he shouldnt mind giving one to you.

At this point, he's threatening to sue me for libel.

I do not think he would give me the password, unless I had a court order to force him to do so.

Then you should try and get one. Or at least contact Freeola Services and have them to monitor the site.

He doesnt have a case against you. Hes only threatening you to get you on the defensive, when you have done nothing wrong. They are the ones who stole your material, and are now hiding. It only makes them look even more guilty. Why password protect a web-site if you have nothing to hide?

You should ask yourself, "Do you honestly believe that they have removed your material?" I dont believe they have, and getting viewing access to that site is the only way to make sure.

Or you could really cheese him off and ask to join the DracoAlliance as a member.

Seriously, Brandon, have you consulted a lawyer yet? Take your emails and assorted other postings to one and see (1) if you've got a case that would be worth pursuing and (2) how much it would cost you (assuming you can't recover those costs from the DA jackasses).

You should also send additional complaints to Freeola regarding the spam. No need to mention any suspected connection to DA, just complain about emails from "spam@kinghell.com", which is hosted on their servers. If it comes up, you can always sue Freeola for allowing this nonsense to continue (since they presumably have deeper pockets than the DA jackasses).

It might be productive to ask Freeola to check behind the password and see if B5Tech is still being ripped off. They have the legal right to do so, and that way Brandon has passed the checking to a neutral 3rd party. Assuming Freeola isn't going to just blow him off.

It's $150 to file in federal court, and lawyers' fees can skyrocket unless you're able to convince one to take the case pro bono or on a contingency. If you win, you get court costs and you can make a request for attorney's fees in the complaint along with whatever other relief you are seeking.

Signing you up for spam lists is the last act of the terminally pathetic. I receive approximately 300 spam messages a week, and I know for a fact that most of them are the result of Trekkies signing me up for lists (the fact that they signed me up under names like "ignorant dipshit" and "warsie asshole" is a pretty clear sign). The fact that I have SpamAssassin installed pretty much nullifies that problem, but it still says a lot about their pathetic mentality.

Funny, in his first letter he stated he knew nothing about making webpages, and had his "little brother" do it for him.. whom also apprently knew nothing about webpage building, having to just copy the b5tech site... yet he knew how to do something like password protect a section of his site...

I've been following this thing from the start. I just want to add my support to the general opinion of the dickheads who did this. Also, I realy advise you to get a legal opinion on all of this, pronto. Get everything together including the first screenshots, the emails, the changes of address e.t.c into a coherent series of documents and get an opinion on what your options are for shutting them down, sueing them for plagerism, the more or less outright threats against your person e.t.c.
