I can explain this.

Those are sold at greately reduced prices to educational systems and institutions. For instance, my own computer store sells student versions of Windows XP Pro and Office XP Pro, at $50 and $60 respectively.

The reason they are unlicensed is, well, because they are unlicensed. They are unlicensed until you buy them, because you sign a license agreement.

actually I thinks its more like the situation where a computer manufacturer such as dell provide software to you but do not provide the license. In most cases the software is loaded on the reinstallation cd and thus no license is provided. The license is probably part of the installation screen when you load it up and it shows the licensing agreement and you click yes to accept or no. I"m only guessing here so I'm not entirely sure.
