As defined by who?
It does not even has to be a fair trial. It´s already enough if they get any trial at all. If the person is found not guilty in a obvious show trial in their own country the ICC has to proof that the trial was blatantly faked if it wants to hold a own one. These rather extreme hurdles were build in after extreme pressure from the usa (still under clinton) against almost all other nations.

Also saddam can´t be put on trial in front of the ICC for the invasions since it applies only to crimes committed after 30. june 2002.

He won't let himself be taken alive, anyway. It isn't in his nature to do so, and it would be pointless to even try, at least in my opinion. If we do try, we'll fail.
