Actually all that would indicate is he doesn't think things through and has massive anger/aggression problems. Or do you intend to argue that crime is the result of mental problume a person can't control?

However, Shep doesn't seem to have good impulse control due to congitive difficulties. It's a sutble difference between insane, and legally insane. He knows it's wrong, he just doesn't care.

I don't think he has a choice. He 'knows' it's wrong, but due to cognative problems, he thinks it's the only option.

It also depends on if we are talking about the laymen's use of the term insane or the more technical, psychological term. He's definitely one, but not necessarily the other.
