It's not the responsibility of a sleeping sunbather to notice a car bearing down on her. It is the responsibility of the driver to avoid running over people.

What indications? Did you read the article? It said nothing whatsoever about either of them being awake or aware of the truck, and it sounds like she DIDN'T see it.
Most sunbathers do in fact close their eyes and relax when they're lying on the beach. You don't have to reasonably exercise the same situational awareness while lying on the beach that you do while crossing a busy intersection. It is 100% the driver's fault.

People lying on the beach do not have any obligation to be on the look out for cars. I dont see how the police are not 100% at fault, unless the sunbathers were in a some restricted zone, but it does not sound like it.

Most sunbathers do in fact close their eyes and relax when they're lying on the beach. You don't have to reasonably exercise the same situational awareness while lying on the beach that you do while crossing a busy intersection. It is 100% the driver's fault.
Connceded, However even your avarage sun bather looks up when they hear the drone of a car that slowly grows louder and louder, most folks look up to see where it is, I know I do
I never said it was not the Drivers fault I'm just wondering how the heck you miss a SCV bearing down on you

I would "assume" the SUV watch driving slow, so they might not have heard it or if they had become used to seeing police cars on the beach, they may have ignored it.
Im completely used to vehicles being banned from beaches where I live so a car would catch my attention. However, the beaches here suck, so I would not be soaking up the sun either. ( The beaches are too cold)

Most of the police vehicles that go offroad, even on the beach, will generally be SUVs (esp. Explorers or Cherokees).

Eh...it was Miami, what do you expect? The only Americans who drive worse than the Miami people are the Puerto Ricans. I still say we build a cement wall ten miles south of I-4 across the state and sell that half to Spain or Cuba or whoever the hell is stupid enough to buy it (sorry, Vorlon

Do police routinely drive on beaches in Florida? Or at least parts of Florida. Im so used to beaches here where they are not accesable by vehicle.
