Laws of the Ban

Darth Wong has announced that a user may only be banned if there is consences that he/she is a troll, and therefore detrimental to the forums. I believe there should be specific guide lines to actually removing a user. Thus I present you..........

-------------------------------------------------------------------------------------

Procedures for banning a Star Destroyer Board user.
-------------------------------------------------------------------------------------

First there must be several offices created:

Supreme Court:

Current Supreme Court Justices- Darth Wong

Lower Court:

Current Lower Court Justices- LordChaos, IDMR

Forum Attorneys:

Current SWvsST Forum Attorney- unfilled
Current PSW Forum Attorney- unfilled
Current OSF Forum Attorney- unfilled
Current S&L Forum Attorney- unfilled
Current OTF Forum Attorney- unfilled

Jury- a panel of 6 regular SDBers of good standing

-------------------------------------------------------------------------------------

The Supreme Court will be made up of all current Administrators

The Lower Court will be made of all current Moderators

The Forum Attorney shall be chosen by that forum's specific Moderator, and should be a member in good standing.

Jury shall be chosen by the Lower Court Justice whose board has been trolled by the troll in question. They should be regular members in good standing, and not directly involved with the troll in question.

-------------------------------------------------------------------------------------

Procedures shall be as follows:

1) Once a Forum Attorney finds a troll he/she must report ( through PM) to that forum's Moderator. He/she must present evidence that the user in question is spamming, abusing the board, antagonizing another user, or in some other way violating the Terms of Service.

2) The Moderator will then decide if the user is indeed a troll. If he/she is, the Moderator will then serve the offending user a warrent. The offending user shall have three days to appear, at a predetermined time, before a Court thread* that is in the Moderator's forum. The Moderator shall then choose an impartial jury of six regular users in good standing.

*Note: No one may post in this thread save the Moderator, the offending user, and the Forum Attorney. The jury may only post their votes in the thread once the troll and Attorney rest their cases.

3) Once the Court is convened, the Forum Attorney must present the Board's case against the user, as well as evidence against the user to support the case against the said user. The Attorney may also present witnesses to the court.

4) The user in question may defend him/herself, and may also request that another user be appointed as their defense. The user requested may refuse the request. The defense may also present witnesses to the court.

5) The Jury will then way the evidence and convene privately on the verdict. They must choose among themselves who will post the final verdict.

6) If the defendent is found guilty of the crime of trolling, the Moderator must then render judgement. Whether the troll will be banned or not, and when, if ever, he/she will be allowed back on the boards.

7) The user may then request a mistrial, and if the Moderator allows, the case will go to the Supreme Court of the SDB.

-------------------------------------------------------------------------------------

Special Previsions:

1) If the case invoves a Attorney or Moderator, the case will automatically go to the Supreme Court of the SDB.

2) If the case involves someone the Attorney or Moderator is directly linked to, they shall step down from the case, and another Attorney or Moderator from that Forum will fill their spot. If there is no other Attorney or Moderator to take his/her place, the case will be sent to the Supreme Court of the SDB.

3) No Attorney may prosecut in another Attorney's forum of authority.

IMPORTANT: All users are considered innocent until proven guilty in the Courts of the SDB.

Of course, these laws are subject to change, and don't mean diddly if the Mods and Mike don't approve of them.

Looks like it could be interesting.

I think that is the longest post I've ever made. :o

You should post more

Though that seems a bit much in the way of 6 people
Make it three and otherwise I'd agree, but it might take quite awhile to get people banned(IE Far to long)

So Possible Troll must Defend himself and Atterny must prove his is a Troll, Judge to make sure no improper things are used(IE Personal Emails, Credit Card histroys you know :D) and three people to vote Yeah and Ney on it would be easier. In the event of a Tie The Judge casts the deciding vote(Any Jurier may abstane)
Precdings made public after the fact?
Just summing up what you said
+ Wong who has right to overthrow any desisions

All procedings would be public, but no one else is allowed to post in the thread.

A new thread would be created for every troll, and that thread would be lock after the verdict.

While it all sounds very interesting and fair and everything, it might be a little too much to actually accomplish...especially if it involves the troll's cooperation.

I know Darth Wong doesn't want to seem like a forum Nazi, but I think giving him all the power seems like the best idea.

"That sounds an awful lot like a dictatorship."
"If it works..."

I've told him as much, but he refuses to listen. I don't like it either, but this may be the only way it's all fair. If the troll doesn't cooperate, we'll assume guilt and procede without him.

Web forums can not be run democraticaly to this degree.

yes, by all means, express you opinions. odds are that if the majority think something should happen, it's going to (assuming possibilities for it to happen exist). However, when it comes right down to it, Mike has the final say as to what happens. We moderators are only here to "keep the peace" (by attempting to see to it that Mike's rules, such as they may be, are not blatently trampled).

Aye, but the rules are unclear. I'm tring to make sense of this voting stuff he wants. But, like I said, it's your decision.

Good ideas all, but it just seems like a huge hassle to me. The method used in the disposal of Sith whatshisname seemed to work fine.

Sith Ass? No that's not right.

Heh heh ... I think we should be somewhat democratic, but I wouldn't go so far as to have all those procedures.

Basically, if someone tells me there's a troll and I confirm his extreme trollish nature for myself, then I'd just like to see that people generally agree he should be banned before I use my Sith powers :)

Well Wong the General idea is to keep you as unessary as possible
IE in the event a Large 40m Metorright where to suddnly land on your head the Board could still go on, IE Bannings, Witchhunts, Inquesitions you know the fun stuff, unhindedrd withere you where here or not)

Defense in Depth I say

Would the defendant also get an attroney to represent them? Or would they have to do all their defending themselves?

No good... if that happens, the board goes away because no one pays the bills.....

(and he's the only one with the sith powers right now... gotta work on that... ;) )

Without sticky powers LC is just a weakling. :D

To answer Manji, the troll would defend himself, unless another is willing to act in his defense.

But the point has been rendered moot now.

Who would WANT to defend a troll? If someone defends a troll, they run the risk of being targeted themselves as a troll, and rightly so. We don't need a repeat of the Spacebattles Trekkie Troll Effectâ„¢ here. I saw the Sacebattles BB and I could only take 2 seconds before I started running a very high risk of my head exploding catastrophically. That would make my Sith Master very unhappy indeed... Then he would take my new planet killer away.... Lata and Happy Fragging!
