It's not impossible that he could be charged with something for making that statement, though not something so severe. There would probably have to be a complaint and an investigation first.

Surely there is something in the USAPATRIOT Act that can be used to put him away in Camp XRay.. Cmon! We can round up people who who say the president should be killed over the internet but we can't get a guy who says that the state department should be nuked on national television?!
