Don't be so sure. If the parent can show that a typical children's playground has bars which are painted in a more eye-catching colour, then she may be able to argue that this particular playground did not meet informal industry standards (there are numerous legal precedents to establish the validity of this "industry standard" argument). Ergo, the park's failure to meet its "duty of care" led to the child not seeing the bar, hence he bumped his head, hence he did lose wages because he's a child model, etc.

Laugh if you want, but as perverse as it may seem, the mother might have a chance here.

Hey, Japan makes electronics, and Saudia Arabia has oil.

What are we known for in the U.S.? Stupid-ass lawsuits like this one. They're our greatest natural resource.

Sue the parents for gross negligance for letting there child run into said bar

Isn't Canada's system set up so that if A sues B and loses, then A has to pay B's legal bills?

That would certainly work, though that galactic judicial system in JL had a good system. Any punishment administered to the defendant is administered to the defending lawyer. Good bye lawyers. :twisted:

Come-ON, people! This should be thrown out of court! Hell, somewhere, a child has bumped their heads, or fall down and skinned their knees every second! Their Children! They Do that!

I believe that's a false anology. This is a child model. With stitches, he won't be able to work untill it heals.

I'm not saying I agree with the case however. The parent should take responsiblity for this, not the park.

Just a bit of a background for you. Fairfield County CT (where this is taking place) is one of the richest places in the country. Filled with the country homes of New York Socialites and infested....er...populated with far more than the fair shre of wealthy attorneys. The place reeks of arrogance and self entitlement.

I know that's the way here in Germany. There are many stupid lawsuits here, especially neighbor disputes, but you no frivolous lawsuits as that one, af far as I know...
