Well I don't want to go into details but here I go;

I was in a car accident a few weeks ago where I was hit by a truck ( I was driving a subcompact). In my viewpoint, it wasn't my fault. There was a 3rd party that ended up in the accident who saw the entire collision before he was struck himself. He apparently agrees with my side of the story of what happened. But when the police report came out, the police had got my statement wrong and made it look like it was entirely my fault. Not only that they've also ommited some facts and had made several errors, all of which I can proove on the spot. I can also get a seperate statement from the 3rd party stating similair concerns about the report as well.

The problem I face in the end is insurance settlements. The insurance company of the person who hit me offered a 75/25 payout. They would cover 75% of all my losses and my company would fork out 25%. Originally they opted for a 50/50 payout. :? I can think of a lot of reasons why they did that.

What I'm trying to do is to see if I can file some sort of complaint or contest the report because of all the errors and facts that were ommitted from the report. Has anyone have any experience in such matters? I don't want to get penalized for the mistakes of others.

If you want to contest the matter in court, that is your legal right. What happens is this: The claims are paid as per the agreements made by the insurance companies on behalf of their respective clients. When the case is heard in a local court, the judge rules, and that ruling stands. If your evidence stacks up, you've got nothing to worry about. But it is entirely possible for a case to be turned completely around (ie that the judge would find you at fault) and you would be liable for the payments. If the other person is found responsible for the accident, the insurance claims will be adjusted and you will get more money from the other person's insurance company.
