Marriage amendment bombs in Topeka

This afternoon, a Court-TV news-crawl stated that the Kansas House of Representatives failed to pass a defence of marriage amendment to the state constitution, which means the measure won't be put before a popular vote. If stupid shit like this can't make it in Kansas, that pretty much signals that the Morality Nazis won't get 34 states to go along with it either.

I thought it was 38 states to actually pass the amendment.

But forget about the states, the amendment that's currently before Congress is already doomed to failure.

Surprise, surprise. It was pretty clear from the begining that this whole Gay Marriage Amendment was a pipedream. So far its only purpose has been to manufacture an issue (one which is really going to be decided in the SCOTUS anyways) so the Conservatives would have something to rally around come November election

That's going to depend on your point of view.


I'd say it's bad because IIRC it's an obnoxious attempt to make it so the constitution bars same sex marriages. That way individual states could not decide to allow same sex couples to marry.

It's basically an attempt by the homophobes to inflict their opinions and beliefs on the entire country instead of keeping them to themselves. I'm sure they feel somewhat the same way about other state's allowing same sex marriages but that's just too bad.

Is it a good thing? Well, only if you think that homosexual marriage is so awful that not only should it be banned now, but the highest law of the land should be amended to make sure that future generations can never legalize it, no matter how society evolves. Obviously, to me and many others around here, it is definitely not a good thing for several reasons. First, it is immoral and wrong (though obviously that is subjective). Second, it is very foolish and even dangerous to use the Constitution for social engineering, especially if you are trying to halt a natural trend.

That statement is incorrect you have forgotten that admendments can be struck down by other admendments. Prohabation, 1930s there was an admendment forbidding the sell of liqour. By a trip to the nearest American bar (if there is one near you), you can see that it is no longer in effect.

On the subject. The Constitution does not exsit to make any group's morals law. I would oppose this admendment as would many of our nieghbors, not because we support the lifesytle, but because this violates their human rights and is a breach in the seperation of church and state.

Anyone can see with a quick scan of history or international politics that mixing churches and states, doesn't work that well.

I am well aware of that, however it is very difficult to ammend the Constitution. It is possible, but it doesn't happen often. The folks currently working on the gay marriage ammendment are clearly trying to make it as hard as possible for anyone to legalize gay marriage in the future.

Unfortunately for them, the act of making this amendment itself impervious to future amendments, if found out, will kill the bill simply by raising the possibility of making something in the Constitution permanent, a concept anathema to our current system and too bitter a pill to swallow for most Americans...

It'll probably be successful on through the lower South, but it'll never fly on the coasts or Midwest. The only state outside the bible-belt I can see passing it would be Utah.
