No, we don't. People constantly throw this out there and these two issues have nothing to do with each other. Homosexuals trying to visualize themselves as on par to being as persecuted as the black community was in America is just absolute bullshit.
Attempts by the current President of the United States attempting to push through Constitutional amendments to enshrine nationwide discrimination into law for fear of having his precious prejudices ruled unconstitutional is meeting with nationwide support conveniently refutes your statement outright. Never mind that people are fired for their sexual orientation with impunity, and all the other objectively proven crap that they have to go through because of being homosexual.

Ah, point. But here in Louisiana they scream "OMG! THE CHILDREN, THE CHIIIIILLLDDRRRREEENNNN!!!" the moment a gay guy asks a peep about his rights, right as the fucktards destroy educational opportunities for the exact same kids just to enrich their personal bank accounts with public Taxpayer money. The kids are not the Christofascists' concern, they're cannon fodder for the Anti-Gay Crusade. If they win this day, who's to say we won't have to repeat the Civil Rights struggle of the '60s again?
Remember, the same arguments they use against us now are the EXACT SAME for their perpetuation of racism, segregation, and slavery.

They feel that on a fundamental level they're being illegitimatly discriminated against just like blacks. No one's claiming they're being hit with fire hoses and attacked by police dogs.
The most basic assumption about the world is that it does not contradict itself.

I'm quite aware. That's what's depressing. America has been getting steadily further to the Right, and for every battle won against bigotry and hatred, two new battles will unfurl to be fought. And the same beatings, murders, abuses, and miscarriages of justice will repeat themselves.
It's almost enough to wish a radical event that would force the USA to rebuild from near-scratch. Almost. I'm not quite amoral enough to wish the attached suffering on hundreds of millions.

Maybe a staggering event is what we do need. Or simply a reversal of the flow of emigration back to Asia, Europe, and the rest of the world that starts as a trickle and becomes a torrent as people realize that Fascism is taking America over like a cancer...
<sigh> You know, I really didn't want to have to have SCOTUS swing the big hammer and overrule Christ knows how many state constitutions, but it's clear that's going to have to happen. And oh how people will howl.

I think you'd need a massive shakeup. Emigration won't work; alot of people never go more than three hundred miles from where they're born. They just wouldn't notice. Or maybe they'd be glad those damn 'chinks' 'eurofags' and other such colourful slang terms for outsiders, have left.
Alot of America is rural. Alot is isolated. If there's a mass exodus from places like New York and San Fran, why would they care? They might even see it as a victory. No, barring some massive shakeup, there's no fast or easy way out of this spiral. A succession of old-style Republicans(Educated, anti-waste, benevolent fellows) and restrained Liberals(Centrists, as we Euros would call them) might do it, but I fear we may not see either of those beasts in power for a long enough period.
But maybe I'm paranoid.

Excellent point, Sir Nitram. I also think this country is headed for a major (and I mean "So MAJOR the Christoterrorists think Judgment Day just arrived") within a hundred years, and the late 20th and early 21st centuries will be remembered for America's stagnation before the Big One.

Rhenquist: Nixon (R)
Stevens: Ford (R)
O'Connor, Scalia, Kennedy: Reagan (R)
Souter, Thomas: Bush (R)
Ginsberg, Breyer: Clinton (D)
You should notice right away that seven justices were appointed by Republicans, but there aren't 7 conservatives on the court. President Ford was pretty liberal for a Republican and his appointment reflects that. Souter just fooled President Bush and the Republican party.
As for which justices are likely to retire, it's hard to predict, but Clarence Thomas is the only one born after 1940. Rhenquist, Stevens, and O'Connor are the oldest and most likely to retire. So if all three retired and Bush appointed their successors, the court would become more solidly conservative. If all three retired and Kerry appointed their succesors, the court would reverse itself completely, with a lot of 6-3 liberal majorities.

Dunno, but four more years of Bush could well turn the tide against the right without any major trauma. 12 years of republicans gave us 8 of Clinton, and the rightists have been screaming foul ever since. Kneejerk action-reaction is the name of the game in American politics.
Public opinion ebbs and flows in this country, and god help the president that performs badly when so many hopes are pinned on him, after all, look at Carter.
4 more years of Bush incompetance and meaningless waste of American lives, retrograde social activity, and indifferance to the disappearing middle class might well give even the most fervant of believers in the GOP reason to vote differently in '08.
I don't know if it'll already be too late then, and I don't know if I want to be part of an American people who needed these four years twice to take a fucking hint.

The arguments owever are the same. Try it some time, take a speach from any of the anti-gay marriage politicians, and replace the words sme-sex, gay, and homosexual with Interracial, black, and nigger. You will find that the arguments are remarkably similar.

In spite of the generalising red herring of what homosexuals visualise themselves as, would care to even try to justify this "No, we don't" comment, or show how discrimination based on sexuality is different than discrimination based on race?

It raises interesting issues, though. Can the Constitution be unconsitutional? What about SCOTUS? Whose Constituion is more valid? And before everyone yells "US constitution, dummy," remeber that we do live under a federal system of partial sovereignty between states and national government. I personally believe that SCOTUS would have the power to strike it down, but the state's rights shitstorm that would follow would NOT be a pretty sight. Does anyone know if a US Consititution vs State Constituion case has come before SCOTUS ever? That would be interesting....

But still, there are issues. For example, it doesnt explicitly say that gay marriages are legal anywhere in the consitution, so Louisiana has that going for it. Also, considering the 5-4 conservative bias in SCOTUS right now, would the ruling be what we want to see? They might not go so far as to say "this is a good ammendment," but even sending it back down to a lower court because its still a battleground issue could be devastating.
