Clinton in 08?
Could he legally run in 2008 for President? I've seen people say he can't because of his two terms, but others say he could because it wouldn't be two consecutive terms.

He already served two terms, and that's it. If he served one term and Bob Dole won, then he could run again. But that isn't the case.

He can't. I've heard off-hand he looked into the issue toward the end of his second term but the supreme court said that it was clear that someone can only be president for two terms.

However, he could be Vice-President and take over if the President resigned/died/was impeached. It's not a situation that would happen, but it is legally possible.
Oh, god. G. W. Bush could run in '08. He wasn't elected in 2000, he was appointed by the SCOTUS .*
*This is a joke (I hope). Please do not take it seriously .
[edit]And, erm, are you sure this shouldn't be in N&P? I know it's not current politics, but OT seems a bit odd placement for it.[/edit]

Political question. I shall send it to politics and let the wonks have it.

Politics threads belong in "News and Politics." I can't understand what is so hard about this to grasp.Jadeite wrote:Well, I know it involves politics, but the stuff in N&P is usually more complex then a single easily dismissed question, so I figured off-topic would be better.

Actually I'm fairly certain it could not, the law says no person may be president for more then 10 years. If he became Vice President when there where 2 years or less left in the term, and then the president died, then that would be fine. The Dark wrote:However, he could be Vice-President and take over if the President resigned/died/was impeached. No person who isn't qualified to be president can be vice president, and already being in office for two terms disqualifies Clinton.Sea Skimmer wrote:Actually I'm fairly certain it could not, the law says no person may be president for more then 10 years. Where is this change? Article II of the Constitution merely requires the VP to be 35, natural-born citizens, and residents for 14 years. Amendment 22 states that no President may serve more than two terms. It does not say anything about Vice Presidential requirements or limitations.Durandal wrote:No person who isn't qualified to be president can be vice president, and already being in office for two terms disqualifies Clinton.Sea Skimmer wrote:Actually I'm fairly certain it could not, the law says no person may be president for more then 10 years. No, its a two trhids majority in both the house an senate, and three quarters of states, a far more demanding task. And there is just no way any amendements are going to get passed under the current political climate.Thinkmarble wrote:Could Bush get away with repealing the 22nd Admendment ?
What do you need to do so ?
Simply majority in House and Senate and two third of the state government ?
Just imagine: Bush repeals the 22nd, Clinton runs in 2008 and wins *g*
That would be funny

Pertinent quote:
It's dodgy, but theoretically possible. The 22nd Amendment states: "No person shall be elected to the office of the President more than twice, and no person [who has served more than half a term] shall be elected to the office of the president more than once."
The language is quite clear. It places no limits whatsoever on how many terms someone may serve as president, only how many times he can be elected.
In other words, the 22nd Amendment does not set conditions on what the 12th Amendment calls eligibility to the office of president. Anyone who is born here and has lived here for 14 years becomes eligible to be president on his or her 35th birthday and is then so eligible forever.

It's only theoretically possible if SCOTUS would chose to ignore the original intent of the amendment and instead ruled based on semantics. Let me know when that happens so I can book my ski tour in Dis.Petrosjko wrote:Check this outThe Dark wrote:Where is this change? I agree. Considering how stacked the SCOTUS is going to be by the next election, though... ain't gonna happen.
God, I hope not. But I wouldn't put anything past the Republicans these days.Symmetry wrote:I suddenly have this image of the Republicans supporting a repeal of the 22nd ammendment in return for altering the natural born citizen clause to let Arnold run. I can dream can't I?

So Bush could end up serving a third term? The 22nd Amendment states: "No person shall be elected to the office of the President more than twice, and no person [who has served more than half a term] shall be elected to the office of the president more than once."
