Sure they are. ASEAN is in particular offensive in this regard. Pirates operate with virtual impunity, as jurisdiction is something which doesn't overlap easily. All a pirate has to do is beat the Navy patrol boat across to other territorial waters, and they're safe from harm.

You see, we combat piracy as strenuously as we can, given our resources. We could always do more, no doubt about it. But we can't do shit in another nation's territorial waters, we can only do what we want in our waters. And if you start opening fire on ships that belong to other nations, with citizens from other nations, operating in their territorial waters, then I would like to know how that can be construed as anything beyond a declaration of war. Even if it isn't considered that by law, since the boats that would be targeted would be pirates, there's no guarantee that the other country will see it like that, and relations between your country and theirs will go down.

Territoriality sucks. But what can you do?
