In theory the 9th and 14th ammendments cover this issue.
They do in that they incorporate Federal laws to be binding on the states, but Federal law doesn't define GLBT people as being in the aforementioned protected categories.
If the civil rights acts were amended to include GLBT people then of course the laws would be binding on all the states, including such oases of tolerance as Alabama.
Until then (or such time as the courts reinterpret 'gender' to include GLBT people*), gays and such are not covered under Federal civil rights laws.
*If you though the MA gay marriage issue touched off a shitstorm, wait'll the courts do this.
