The judiciary barred the mutilated version of the Pledge of Allegiance from being mandated in schools. But Congress voted almost 100% to force the issue and try to overturn their judgement. Fundies are far more dangerous and powerful than you are willing to admit.
Prostitution is illegal (in most places) I would assume because few people have challenged it It
is legal in Las Vegas, where it operates under regulation like any other industry. Homosexual marriage I will grant you; that stems from Biblical concepts of immorality. As far as sex toys go, I have no idea. That seems outmoded even to me, something like the apocryphal law that you can't ride a camel underwater with no pants on. As far as barring atheists from serving in public office, that's simply a useless law -- anyone can
lie and say they believe in God when they don't. As far as the Boy Scouts go, they have every right to bar Atheists from joining, much as the Girl Scouts have every right to bar boys from joining. It's a
club, as far as I know.
Most of these laws are still laws because, to the best of my knowlege, they haven't been challenged, or because they've been upheld by the majority.
