What are the chances that Dante doesn't even know what filing to get a court order entails? He certainly doesn't seem to understand the rest of the process.

Looking at the DMCA again, I don't see any further steps listed to get the clip back up automatically. I think this means you're at the point where you need legal action to restore the clip and therefore need a lawyer. If this "court order" is real, you need a lawyer to defend against it, and if it isn't, you need one to get your own court order to get this clip back up.

:evil: Yet another flaw in the DMCA. It provides a whole 10 business days---enough time for the complainer to go to court and get a real preliminary injunction to keep the alleged infringing item down, but lets the complainer just claim that they've gone to court instead. Stupid, stupid, Congress creatures!

Actually, he does have to bring the lawsuit. Failure to bring the lawsuit, now that he has notified YouTube that he will, is yet another DMCA abuse and, if I choose to be vindictive enough (which looks likely at this stage), could be used to bury him further. The fact that he continues to sign all his e-mails to YouTube with his fake name further digs his grave if I were to press the matter.

That said, if I could get his real name and address, I could file on my end (it wouldn't cost much) and force his hand. The case has to go to the District Court of Maryland anyway per the DMCA as that is the district court where I am as the alleged infringer.

Right. I don't mean that it's legal for him to act this way, only that the requirement for him to keep the video down is too lax and therefore too easy to abuse.

The only requirements I can find that the DMCA puts on him to identify himself are these:

(iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
The former doesn't require a real name. (It's helpful to remember that the law on this dates back to when most people were illiterate and signed with an X.) The latter only requires contact information, not a real name. So I think your hope that him using "Dante Leonheart" will get him in some kind of trouble isn't going to pan out. If you're lucky, it will piss off a judge.

Your best bet is to get the contact information he provided YouTube from them. It doesn't look like they are required to give it to you (more DMCA stupidity), but they aren't banned from it, either. With luck, you can convince them to hand it over without a subpoena and proceed from there.

The name thing can in fact be important, if only like you stated to piss off a judge (at worst, at best it makes his perjury in the original notice even worse). I pointed out two things in my counter-notification: 1) My use of the video falls under "fair use" and 2) the complainer is not the copyright holder nor a designated agent.

I intend to e-mail the YouTube copyright service on May 15th if I do not receive the court order demanding restoration. Assuming the little ass-monkey does manage to convince a court to grant a restraining order, it must be delivered quickly (that would also have his legal information on it and I will counter-file then).

However, I am certain at this stage that he is blowing smoke. I find it hard to believe that any court is going to grant a restraining order given my obvious fair use and, assuming the judge knows a little about Star Trek, his obvious lack of ownership.

My bet is that you're underestimating the legal validity of an assumed name. The only reference I found is Wikipedia, though. It specifically mentions a court case (Lindon v. First National Bank) as establishing his right to enter into legal action under an assumed name.

The way the DMCA is written, I expect that won't do any good. YouTube has to keep it down once they receive his statement that he's gone to court---there's no exception listed, even if they don't believe him. Plus, all your complaint will do is put them in a he-said-she-said situation.

The beauty of the Maryland court system is that all cases, whether in a district or circuit court, are quickly searchable with CaseSearch. It takes only a day for new cases to be posted. "Dante" has to file in Maryland, period, according to the DMCA. And since he has to open a case in order to get his restraining order...

I will also point out that the video has been posted elsewhere and "Dante" is aware that location. No takedown notice was ever given to that site, only YouTube. May not help, but it is interesting.

I haven't seen immaturity or sheer irrational kookishness on that scale since... usenet circa 1998. :) Clearly he is existing in some bizarrely distorted delusional worldview where he is his made up character, this is an epic fight of good-by-definition (him, Trek, his small cult of fanboys) versus evil-by-definition (you, Wars, anyone who points out how ridiculous his crap is) and the world is bound to support him because 'good guys always win'.

Great. Except that copyright is a Federal matter, not state, and so claims have to be filed in Federal court. That search only covers your state's courts, and isn't going to list any copyright action of Dante's. You'd need to look his supposed case up on PACER, which is a for-pay service.
I will also point out that the video has been posted elsewhere and "Dante" is aware that location. No takedown notice was ever given to that site, only YouTube. May not help, but it is interesting.
Further evidence that he's too lazy to have actually gone to court like he claimed.
