Does the real Anderson know that you have created this online shrine for him in Last Bastion? I don't think he ever acknowledged this fact either in his blog, nor on his website. Strange, since normally he reacts so fast to things like this.

edit: personally, I'd say that their accusation of Wayne being a pedophile in and of itself is actionable.

"Poedophile" might qualify as libel per quod -- something that insinuates Wayne is a pervert -- but I'm afraid it's too easily defensible as parody. (Parody's not a universally successful defense by far but, for reasons I'll touch on in a minute, the small audience we're dealing with and the total lack of those idiots' credibility probably makes it a decent enough defense :-\ .)

That's not to say "Dante" and co. are totally in the clear: when he and some of his equally homophobic pals use slurs like "faggot" or "queer," they could be guilty of libel per se (something clearly defamatory; no interpretation's needed).

Interestingly, many of the other requirements for a successful libel suit are present ...

Calling Wayne, a straight man, those names is communicating a falsehood. Even when they don't address him by name, the slurs are clearly of and concerning Wayne. By virtue of being on the Internet, the defamation has been published worldwide. There's no question of fault, either; we're not dealing with a major newspaper printing typos. "Dante" et al. say such things with no regard for the truth.

That said, for this to really be actionable, at least a significant minority of a community -- and not an unrepresentative minority, as SD.net may be -- must think the slurs damaging to Wayne's reputation. That's highly unlikely.

Moreover, over the last 15 or so years, increasingly fewer courts consider "faggot" and the like defamatory. Perhaps if they accuse Wayne of doing something illegal (moreso than simply poking fun at his name), or claim he has an infectious disease, they could be nailed to a cross. Beyond that ... *sigh*

But I don't see those guys talking that kinda hard smack. It's not that they're smart enough to avoid legal troubles; they're obviously quite stupid teenaged sorts who think "fag" is a keen barb :-\

Rather, I think they're just too chickenshit to lie about something that might actually hurt Wayne's reputation.

BTW, the first 2 minutes of LB5 (with the exception of sound fx and music) is complete. I'm waiting on a certain prop to be completed which will be featured within the next 3 to 5 minutes. But in the meantime, I can complete the rest of the episode.

I had no idea of this, and I don't think Starforce or BR32 know that either. I don't have all the details, but when I find out who exactly Poe is ripping in his show, I'll let'em know (if they don't already know) so they can file a complaint with Starforce or BR32 and get that trash taken down.
