You don't have to get into hollywood versions of a shithole prison to have mental torture of being locked up in a small spartan cell two thrids of the day with little contact with the outside world.Zuul wrote:

If you were unable to change that situation, and a death sentence would probably better for people, then prisoners ought to get some sort of "Escape From New York" type option where they are killed and incinerated rather than go to prison.

From a purely cynical view point, it can be considered that 1 innocent executed may well be worth it if you get rid of several murderers.
I do think, however, that the evidence should be solid, includeing the authorities motive is bringing forward the person in question. Technicalities in the law should never allow a person to go free if they commit a crime. Ex: burgler getting off free and sueing the family in question when he got stuck in their chimney (dont have link to that old story, sorry).
Also, in some cases, vigilante justice may be justified and necissary, escpecially when the justice system fails, in deed or in action. There have been instances were I have personnally seen the cops unable to act because of a technicality.
