I honestly don't think this ballot will go very far. I could be mistaken, but last I heard (even prior to the SC ruling) the state was leaning near a 50/50 split over same sex marriage.Kanastrous wrote:And there is already an initiative headed for ballot, to amend the state constitution so as to disallow same-sex marriages.
Fuck. What a criminal waste of time.

It suddenly struck me that that tiny pea, pretty and blue, was the Earth. I put up my thumb and shut one eye, and my thumb blotted out the planet Earth. I didn't feel like a giant. I felt very, very small.

Not necessarily. Remember Dover, Pennsylvania? Judge Jones being a Bush appointee didn't do diddly to stop the idiots from shouting "Activist judge! That and the governator has voiced against the initiative. So that helps a bit. Also, the article mentions that they are going to appeal this to the Supreme Court. But with what arguments?? IIRC, the Supreme Court can only reverse a decision if the previous ruling violates federal law. Am I mistaken about this?

Oh wait a tick
So it isn't going to the Supreme Court. I guess now the final showdown is the initiative this November.CNN Article wrote:The parties cannot appeal to the U.S. Supreme Court, Herrera said, as no federal constitutional questions are at issue.
"This is the final say," he said.
California Gov. Arnold Schwarzenegger said he would not pursue further action.
"I respect the court's decision, and as governor I will uphold its ruling," Schwarzenegger said in a statement. "Also, as I have said in the past, I will not support an amendment to the constitution that would overturn this state Supreme Court ruling."

Unless someone can find, or invent an argument as to why SCOTUS gets to review it.Pint0 Xtreme wrote:

Given the current makeup of that court, I expect they'd seize upon any excuse to interfere, that they possibly could.

I actually highly doubt they would. They would duck the issue or claim no jurisdiction, of which they have none.Kanastrous wrote:Unless someone can find, or invent an argument as to why SCOTUS gets to review it.Pint0 Xtreme wrote:

In addition to this, I believe that anytime the attempt has been made to amend the constitution it's been a bit more difficult than a regular state initiative.Pint0 Xtreme wrote:That and the governator has voiced against the initiative. So that helps a bit.
Plus, there's quite a few months between now and then for people to get used to the idea. IIRC similar happened in Mass when same sex marriages where legalized and they later tried amending the state constitution to prohibit it.

The California Supreme Court has overturned the state’s controversial ban on same-sex marriage (decision .pdf). As NBC’s Pete Williams states, there are already groups in California trying to put anti- same-sex marriage amendment initiative on the November ballot. This makes California the second state in the union to allow same-sex couples to marry along with Massachusetts. More from the San Francisco Chronicle:
The justices’ 4-3 decision Thursday says domestic partnerships are not a good enough substitute for marriage. Chief Justice Ron George wrote the opinion.
The city of San Francisco, two dozen gay and lesbian couples and gay rights groups sued in March 2004 after the court halted San Francisco’s monthlong same-sex wedding march.
The case before the court involved a series of lawsuits seeking to overturn a voter-approved law that defines marriage as a union between a man and a woman. Read on…

Well that and its California so everyone assumes that polygamous child raping gay sex cults are already legalized why should actually gay marriage ruffle any feathers.PeZook wrote:So...if Repulicans do it, it's okay?General Schatten wrote: Actually, my dad was watching The Official News Channel of The Fatherland and the dude said it wasn't acticist judging since their were numerous Republicans in on it.

I wonder if the Republicans will try to use it as a "wedge issue" again. They did that with the 2004 Massachusetts decision . . . but twice in a row?

When ballots have fairly and constitutionally decided, there can be no successful appeal back to bullets.

Thanks for the clarification, at any rate. When they said "largest," I assumed they were referring to literal state size.
