The California Supreme Court has overturned a gay marriage ban in a ruling that would make the nation's largest state the second one to allow gay and lesbian weddings.

And there is already an initiative headed for ballot, to amend the state constitution so as to disallow same-sex marriages.

I honestly don't think this ballot will go very far. I could be mistaken, but last I heard (even prior to the SC ruling) the state was leaning near a 50/50 split over same sex marriage.

That and the governator has voiced against the initiative. So that helps a bit. Also, the article mentions that they are going to appeal this to the Supreme Court. But with what arguments?? IIRC, the Supreme Court can only reverse a decision if the previous ruling violates federal law. Am I mistaken about this?

I actually highly doubt they would. They would duck the issue or claim no jurisdiction, of which they have none.

In addition to this, I believe that anytime the attempt has been made to amend the constitution it's been a bit more difficult than a regular state initiative.

Plus, there's quite a few months between now and then for people to get used to the idea. IIRC similar happened in Mass when same sex marriages where legalized and they later tried amending the state constitution to prohibit it.

As NBC’s Pete Williams states, there are already groups in California trying to put anti- same-sex marriage amendment initiative on the November ballot. This makes California the second state in the union to allow same-sex couples to marry along with Massachusetts. More from the San Francisco Chronicle:

The justices’ 4-3 decision Thursday says domestic partnerships are not a good enough substitute for marriage. Chief Justice Ron George wrote the opinion.

The city of San Francisco, two dozen gay and lesbian couples and gay rights groups sued in March 2004 after the court halted San Francisco’s monthlong same-sex wedding march.

The case before the court involved a series of lawsuits seeking to overturn a voter-approved law that defines marriage as a union between a man and a woman. Read on…

I wonder if the Republicans will try to use it as a "wedge issue" again. They did that with the 2004 Massachusetts decision . . . but twice in a row?

Nah, the avatar's just a take on the "looking around corner - head only exposed" picture from WH40K's Imperial Infantryman's Uplifting Primer that I picked up somewhere; were I only able to draw so competently.

Thanks for the clarification, at any rate. When they said "largest," I assumed they were referring to literal state size.
