The report confirms that Freshwater burned crosses onto students’ arms, using an electrostatic device, in December. Freshwater told investigators the marks were Xs, not crosses. But all of the students interviewed in the investigation reported being branded with crosses. The investigation report includes a photo of one student’s arm with a long vertical line and a short horizontal line running through it.

The family of one student who was burned filed a federal lawsuit last week against Freshwater and the district, saying the student’s civil rights were violated.

Today, the family’s attorney, Jessica Philemond, said it was unfortunate that the school district didn’t do anything sooner to stop Freshwater.

“These concerns had been going on for at least 11 years and the school had not done anything,” she said.

A teacher who worked in Freshwater’s classroom last year also reported to investigators that Freshwater told his class that homosexuality is a sin.

Neither Freshwater nor his attorney, Roger Weaver, could be reached for comment last night. Freshwater’s friend, Dave Daubenmire, defended him.

“With the exception of the cross-burning episode … I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district,’’ he said.

Daubenmire is a former London High School football coach whose district was sued in 1999 by the American Civil Liberties Union because he led his players in prayer at games, practices and meetings.

“Do you think there are other teachers in the public classroom that are trying to drive their opinions in the classroom?’’ Daubenmire asked. “I don’t care who you are. You cannot separate your value system from your teaching.’’

The debate about Freshwater’s actions became public in April after he refused to remove a Bible from his desk, as the district had ordered.

The report says he was insubordinate for failing to remove the Bible and other religious materials from his classroom but also found other issues about his teaching and behavior.
This is just...wow. His friend Daubenmire sounds like a real intellectual giant himself, surpassed in his lofty heights by the guy who burned crosses onto students' arms for not thinking his view of science ("God did it because he loves you and hates everyone else") was correct.

Most of the school was probably sympathetic to the Creationist cause.

If any teacher tried to teach intelligent design at my high school, he'd immediately get laughed out of town. In the entire school there were only a couple of people who were actually Young Earth Creationists. If this guy tried to make us pray or brand crosses on our arms, most of the students would just walk out of class.

According to what? Your say so? There is no legal definition I'm aware of that requires injuries to look a certain way. The threat of violence and physical violence itself is sufficient, as far as I'm concerned branding marks into people's arms against their will counts as battery at a minimum. To say nothing of abusing his position of trust.

It doesn't matter how bad you think the burns look.

Where did I say that it was permissible or that the student could consent?

But I have to concede the point. Intuitively I thought that battery meant literally hitting someone, or causing a bodily injury, and not just emotional distress. Since it basically means "unlawful touch", then this could definitely be tried as battery.

My thoughts: For a cross, that really isn't all that well done. Surely thy God would be less amused by this than by branding it into kid's forearms.
In addition, there is evidence that Mr. Freshwater inappropriately said to his class that science is wrong because the Bible states that homosexuality is a sin and so anyone who is gay chooses to be gay and therefore is a sinner.

Also, as vile as it may be, I'm interested in the science behind branding with electrostatic devices. If there is any of course; after all, science is wrong, and the Bible is right. :roll:

You actually find this shocking? Fundie morons like the one in the article tend to equate homosexuality as sinful and try drilling it into the heads of kids as much as they can. It's bog-standard fundie rhetoric.

Though the article provokes angry emotional responses, this is a valid point. The article did state that "all students named the burn as a cross," but the fact that only one family's trying to sue currently is a bit strange.

It would make more sense if there were several such lawsuits in the past against him which never succeeded, which would suggest pathos as to why there aren't more now. However, that's merely supposition.

A middle-school science teacher is accused of preaching Christianity during class and branding some of his students with crosses, The Columbus Dispatch reports.

The paper says an independent investigation conducted on behalf of the school district concluded that John Freshwater used an "electrostatic device" to burn the religious symbols onto the arms of multiple students last December. (The story doesn't say how many children were involved.)

"Freshwater told investigators the marks were X's, not crosses. But all of the students interviewed in the investigation reported being branded with crosses," the paper says. "The investigation report includes a photo of one student's arm with a long vertical line and a short horizontal line running through it."

The Dispatch says parents had complained for years that Freshwater taught intelligent design and discredited evolution in his Mount Vernon, Ohio, classroom. Now they're suing the school district in federal court.

In April, The Mount Vernon News said one family sent a fax to the newsroom through their attorney, Jessica Philemond, that said:

"We are religious people, but we were offended when Mr. Freshwater burned a cross onto the arm of our child. This was done in science class in December 2007, where an electric shock machine was used to burn our child. The burn was severe enough that our child awoke that night with severe pain, and the cross remained there for several weeks. ... We have tried to keep this a private matter and hesitate to tell the whole story to the media for fear that we will be retaliated against."

The Dispatch says it couldn't reach Freshwater or his attorney. A friend spoke out in his defense. “With the exception of the cross-burning episode … I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district,’’ Dave Daubenmire says, according to the Dispatch.

School board members were scheduled to meet Friday afternoon to discuss the findings by consulting firm H.R. On Call Inc., hired by the district to investigate. The report was released Thursday.

School Superintendent Stephen Short wouldn't comment on the report before Friday's meeting, his office said. A message seeking comment was left for Freshwater's attorney, Roger Weaver.

The report comes one week after a family filed a federal lawsuit in Columbus against Freshwater and the school district, saying Freshwater burned a cross on their child's arm that remained for three or four weeks.

Freshwater's friend Dave Daubenmire defended him.

"With the exception of the cross-burning episode ... I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district," he told The Columbus Dispatch in a story published Friday.

Several students interviewed by investigators described Freshwater, who has been employed by the school district for 21 years, as a great guy.

But Lynda Weston, the district's director of teaching and learning, told investigators that she has dealt with complaints about Freshwater for much of her 11-year term at the district, the report said.

A former superintendent, Jeff Maley, said he tried to find another position for Freshwater but couldn't because Freshwater was certified only in science, the report said.

Freshwater used a science tool known as a high-frequency generator to burn images of a cross on students' arms in December, the report said. Freshwater told investigators he simply was trying to demonstrate the device on several students and described the images as an "X," not a cross. But pictures show the images depict a cross, the report said.

Other findings show that Freshwater taught that carbon dating was unreliable to argue against evolution.

I've seen the picture of the burn in some articles, its weird in that its a cross of dots and not a single piece like you'd expect. I'm curious as to how this 'high frequency generator' works.

wtf!?! Was it a permanent mark or did it "merely" cause the requisite pain (as opposed to permanent disfigurement)?

Either way, why the hell would anyone think that it was appropriate to do that in a science class? Hit him with various assault charges and get him out of the classroom.

The investigation firm mentioned in the 2nd article, HR on Call inc, released these findings:
The key findings of the report are quoted below.

•Mr. Freshwater did burn a cross onto the complaining family’s child’s arm using an electrostatic device not designed for that purpose. While there did not appear to be any intent by Mr. Freshwater to cause injury to any student, he was not using the device for its intended purpose. Contrary to Mr. Freshwater’s statement he simply made an “X” not a “cross,” all of the students described the marking as a “cross” and the pictures provided depict a “cross.”

•The Ten Commandments together with other posters of a religious nature were posted in Mr. Freshwater’s classroom. Most were removed after Mr. White’s letter of April 14, 2008, but at least one poster remained which Mr. Freshwater was again instructed to remove on April 16, 2008, but did not do so.

•Several Bibles were kept in Mr. Freshwater’s classroom including his personal Bible on his desk and one he checked out of the library placed on the lab table near the desk. Other Bibles that had been maintained in the room were removed by the time the investigators viewed Mr. Freshwater’s room.

•Mr. Freshwater engaged in teaching of a religious nature, teaching creationism and related theories and calling evolution into question. He had other materials in his classroom that could be used for that purpose.

•Mr. Freshwater engaged in prayer during FCA meetings in violation of the district’s legal obligations for monitoring such organizations.

•Mr. Freshwater participated and possibly led a prayer during an FCA meeting that concerned a guest speaker’s health. There is no conclusion as to whether such prayer was a “healing” prayer.

•There is no evidence Mr. Freshwater violated the district’s permission slip policy.

•There is no evidence Mr. Freshwater made statements about FCA members “being the saved ones” nor was there any corroboration to the allegation Mr. Freshwater gave FCA members Bibles for them to distribute. He did have two boxes of Bibles in the back of his room.

•Mr. Freshwater gave an extra credit assignment for students to view the movie “Expelled” which does involve intelligent design.

How easy/hard is it to shape an electrostatic field into the shape of a cross in the first place. I'm willing to believe the other stuff, but deliberately using a device like that to burn a cross-shape sounds difficult. He could just be a retard and using equipment incorrectly on top of everything else.

If you look at the photograph, it seems like he just took it and drug it in a vertical line, then a horizontal line.

If he just dragged it, the normal folding/tugging of skin as he moved it along would tend to create a broken or dotty line anyway.
