It's quite common, and in fact I've seen several who were older than that. It's very easy for it to happen, simply because a kid could have started school a year later. My friend, for example, is about eleven days older than me, but one year lower because she started late. Others either do poorly in kindergarten (another friend of mine) or their parents choose to hold them back (several people I grew up with). In fact, my cousin's school recommended that she repeat kindergarten simply because, while she's intelligent enough to skip first grade altogether, she's very tiny and frail, and they want her to physically mature so that she's in the same class as people of her size.Master of Cards wrote:No it is not in fact common to have 15 year olds in an 8th grade class. Yeah I actually knew a lot of people that were 15 in the 8th grade. One of my good friends got stuck into the 8th grade (they actually were going to put him lower but he took tests and got into where he was supposed to be) when he went into foster care. Their reason for make him stay was that they thought that it would be better for him socially since he knew these people rather than sending him to high school. It wasn't better for him but that's another story
I know a couple other foster kids personally that were basically in the same situation.
I know PLENTY of people who when they immigrated here they got stuck behind (dozens personally).
Then there are the people that were left back through grade failure.

There are plenty of kids at my college in the incoming junior class who are already at least 21 (I'm one of them). I got held back a year in high school though, due to illness.

Of course if the parents did not have custody due to negligence, then they may not have standing to sue... At least according to the supreme court.
