Lawmaker's son indicted in Palin e-mail hacking

WASHINGTON (AP) -- A federal grand jury has indicted the son of a Democratic Tennessee state lawmaker in connection with the hacking of the e-mail account of Republican vice presidential candidate Sarah Palin.
David Kernell, 20, of Knoxville, Tenn., the son of state Rep. Mike Kernell, was scheduled to be arraigned Wednesday before U.S. Magistrate Judge C. Clifford Shirley, according to a statement from the Justice Department.
David Kernell was indicted Tuesday by a federal grand jury in Knoxville for intentionally accessing without authorization the e-mail account of Palin, Alaska's governor, the Justice Department said.
Kernell, an economics major at the University of Tennessee in Knoxville, faces a maximum of five years in prison, a $250,000 fine and a three-year term of supervised release.
His father, a Memphis Democrat, is chairman of Tennessee's House Government Operations Committee. Mike Kernell has said he had nothing to do with the hacking incident.
The indictment against David Kernell alleged that on Sept. 16 he reset the password to Palin's personal e-mail account to gain access to it. Authorities say Kernell then read the contents of the account and made screenshots of the e-mail directory, e-mail content and other personal information, later posting some of the information to a public Web site.
The Justice Department said the case was being prosecuted by section chief Michael DuBose and trial attorney Mark Krotoski of the criminal division's computer crime and intellectual property section and Assistant U.S. Attorney Greg Weddle of the U.S. Attorney's Office for the Eastern District of Tennessee. The FBI's Anchorage and Knoxville field offices investigated the case.

Now then as the good Kernell is the child of a Democratic Senator what are the chances this might have had some political and official backing of sorts? I'm sure this is how it will be spun on Fox News soon enough.
This is the kind of thing I'd expect from Republicans really, but then I wouldn't be to shocked if my theory turns out to be correct.

TENNESSEE state rep, not TEXAS. Regardless the chances of this having any kind of official backing are about as likely as Palin ever pronouncing the word "nuclear" properly.

Without knowing better, one could always ask whether it's considered a privilege of her station to have priority for the FBI to protect her security with fervor. I mean, sure, we're talking about public resources, but public resources aren't necessarily all for the general public's use. I don't think the average citizen could really get too pissy over the fact that, say, a Secret Service man won't take a bullet for him.

Well the response would be certainly justifiable if it were an official US government email account. But she used yahoo mail with all its known faults to communicate. So that raises the question why would she get special treatment compared to say someone else who also foolishly used yahoo for business purposes and then paid for the mistake. I understand important people do need special security privileges but this goes too far. Most people would be laughed off if they lost their yahoo mail account to hackers, but in her case the secret service gets involved. This is a bad way to set a precedent that if you are famous and important you can make a stupid mistake and yet instead of suffering the same consequences as any another citizen the state will treat you special.

The Secret Service gets involved because anyone running for president or VP (I believe) has fallen under the Secret Service protection in recent years. I think the scale of the response is appropriate for this case, because these are official documents at stake. What isn't appropriate is the lack of condemnation for her carelessness.
