The Republicans have used shots and excerpts from the 1967 interview in their advertising but the widow of the journalist who made the film says it was released without her permission.

Mei Chen Chalais, whose husband, Francois, spoke to a bedridden McCain, is demanding payment from at least seven French and American broadcasters.

Her lawyers say they even sent a letter on the rights issue to Mr McCain's campaign team, although Mme Chalais does not want to sue the former PoW.

The French national audiovisual archive, INA, decided to post the four and a half minute interview on its website for a week, evidently much to the happiness of the hard-pressed McCain presidential campaign.

Some of the images from the black and white interview have been used in McCain advertising and on his campaign website.

Mme Chalais has complained that the four and a half minute interview, for which she owns the rights, will be taken out of context when seen on its own.

The interview shows Mr McCain – a former Navy pilot - shirtless and unshaven, smoking a cigarette.

He tells Chalais how he has been shot down over Hanoi and parachuted into a lake.

At times, when speaking of his family back at home, McCain's lower lip trembles and his voice breaks.
It's really getting stupid. Again and again, McCain's campaign is using stuff without so much as a 'by your leave' to the people who own it.

She doesn't need to sue McCain personally, but she can and should sue the GOP and its advertising arm especially. As well as get all the networks to stop playing the ad.

Should the Democrats pick up on this? That the GOP doesn't care for the rights of people and companies, despite its supporting the DMCA?

I doubt the DNC will push this, think of the GOP spin that will get air time- "Liberals don't want you to see the heroic POW videos of warhero McCain."

Besides they don't need to, they already have the lead.

Now as for the woman that actually owns the rights, yeah she should cook up something against either McCain or the INA, whichever is legally at fault.
