Ding! You're wrong. Chemical weapons were used by Costa in action against Costa rebels. Any effect on Baernish troops would have been because they were co-located with the rebels, and therefore belligerents against the Costa government. Attacks by the Costa government against Baerne were strictly conventional. And a government which can maintain a army, navy, and air force typically is not considered failed.
