It goes without saying that that there will be a constitutional crisis if Little Hitler doesn't believe in the authority of the judicial branch if and when the issue reaches the USSC and it rules against the government. IIRC there aren't any consitutional safeguards to dispose of an executive (branch) that doesn't abide by supreme court rulings; the only trap doors are Congress removing Ashcroft, the armed forces 'reminding' (at bayonet point if need be) the executive that everyone in uniform swears to uphold the constitution, or the consitution getting thrown out the window.
