Most of the are deeply religious and conservative but I don't think they're stupid. This is clearly unconsitutional and an violation of the guy's rights. Whether they would patronize them or not is not isn't really an issue, they'll find as the law determines and it's not on Texas's side.

Eh...kind of. It's fiction based on historical events. It's a hacker novel really; about computers and codes and cryptography. It has a lot to do with things like the Enigma code and Nazi gold.

Where the hell did you get this? Ginsburg, Stevens, Breyer, and Souter are all liberals. Kennedy and O'Connor are moderate conservatives who sometimes vote with the liberals. Rhenquist and Thomas are both conservatives, and Rhenquist opposes abortion (I'm not sure about Thomas, but I'd suspect he is too), but a fundy that does not make, and Scalia can't be a fundy because he's Catholic.

I imagine that Thomas, Rhenquist, and Scalia will rule in favor of the state of Texas because they're all state's rights conservatives who believe local communities ought to define obscenity and not have the Supreme Court overturn their laws from On High without a good reason (and since obscenity is well established by the court as not protected by the First Amendment, saying that obscenity laws violate the first amendment isn't a good reason). The four liberals will undoubtedly rule for Castillo, unless there's some legal detail that ties their hands--in other words, Texas obeyed all the guidelines in establishing an obscenity violation. That leaves Kennedy and O'Connor, and they're sorta unpredictable, though in my mind, the fact that the prosecution didn't even bother presenting evidence seems to say to me that the jury was biased and no obscenity was established.

The SC doesn't have to pick between throwing out Castillo's conviction or upholding, just by the way. THey can refuse to hear the case at all if they think it doesn't have enough legal merit to be heard, or they could agre the conviction was flawed but refuse to rule on whether or not the comic was actually obscene, and order a new trial for Mr. Castillo. The one thing they won't do is issue a ruling that overturns the obscenity exception to the First Amendment, thought if we're lucky they may tighten the legal definition of it and raise the bar for local communities to prove it.

Shrub has nothing to do with this. All the executive branch can do in a Supreme Court case (where it's not either a plaintiff or a defendant) is issue a friend of the court brief for one side or another. When the Court makes a ruling, nothing short of a Constitutional amendment or another Supreme Court ruling that overturns the first one can change it.

When this was brought up in Space Battles, I brought up the full contents of my Adult Comics. (All of which I bought after I was 18, many of which I read in High School, just to piss off the Vice Principal (I was an "Adult" half of my senior year ya know). Arthur Dent called it a bunch of sick Porn.

I pointed out that titles such as: Black Kiss, Crow, Marshal Law, Blood, Blade The Immortal, Cry for Dawn & several others I owned were rated "Adult" for the graphic violence factor and didn't have any actual "Porn" as per the supreme court definition. And while Milo Manara comics are incredably heavy in the sexual content (They are very tasteful and not Mysogynistic).

Now for my "Barbarian Comics", "Faust Love of the Damned", "Little Witches", & some of my Japanese comics, I have no idea what my defense is.

Mind you, I really shudder to think what the folks in Texas would think of Italy's "Black Kiss" (Vampires ruling the Inquistion, Currupt Vampire priests "taking" prepubescent boys both for their blood (and inconversation to rape as well (note the molestation is never depected), Robber Knights etc.)

This is just stupid. The prosecuter just basically admitted he didn't care up truth, but about his own ideology. Where's the mistrial?

And for a format that is only for kids, let's see what the number 1 movie at the box office is, oh yes, Daredevil. And of course only kids went to see it to make it number 1. :roll:
