The move comes courtesy Suma, a 24-year-old transsexual, who decided it was time to get an MBA. "I was tired of sex work. But when I went to the college (a private one, not affiliated to Bangalore University), the principal asked me, "Under what category do we put you...you are neither a girl nor a boy...and because of one student, everything will get spoilt." She then approached the Bangalore University.
Suma underwent a sex-change operation a few years back. She says she was forced to do sex work, but dreams of the time when she will have an MBA degree and will be "as respected as others" in the society.
She presently works at Samara, an NGO that works for the rights of transgenders. Samara is also supported by the Bill and Melinda Gates Foundation.

If she is merely categorized as "other", it's not much of an improvement. However, the article says nothing to that regard. Rather, it implies that the opposite is the case - that she is accepted as female.
But it does talk about protection from discrimination, which is great. My congratulations and respect for that University and for Suma.

This is a major step forward, socially, for that culture. It is still short of full enlightenment, but it is a step in the right direction.
But yeah, Hav is right, technically she is a girl and should be recognized as such. But even in the US, that is not universally accepted. In Washington State, they will re-issue a transgendered person a new birth certificate with the "new", proper gender. Meanwhile, Texas state law does not recognize it and official paperwork is processed with the gender listed on one's birth certificate.
In fact, there were recent legal cases in both Idaho and Texas that drew attention to the issue...

In WV, we handle the change of gender by the same rules we use for any change on a certificate on file : Give us a Court Order stating the change is to be made.

Bascially the same in Germany. Question is: Do your courts decide in favor of transsexual people? How does the process, if it exists, work with your courts? What are the conditions and procedures with the courts?
We have a standardized process, cemented by law. The procedures take about half a year tough, and to get the actual birth certificate changed instead of just the first name (tough the effects of that are pretty much all you need for nearly all instances) you pretty much are required to already have SRS - which means that it takes even longer.
But at least the process is pretty clear cut and contains few stumbling blocks.

There's no nationwide law dealing with it, although I think (not sure here) that transgendered people who suffer from discrimination or hate crimes may have some Federal protections. But the crime would have to cross state lines for the Feds to care, otherwise they let the state handle it.

Yes, i know that the USA handles such things on a state level, which is why i was asking Lady Tevar how the court orders in WV worked.

I'd love to be wrong on this, but I don't think the transgendered are a Federally recognized group for such protections.

Court-order allowing the name change, and a physician's notarized statement of having undergone the surgery, and your gender is legally changed. The name change can only be turned down if it's going to cause injury to someone from the name alone(So you probably can't name yourself Tom Cruise), but once those two are done, the registrar creates the new certificate and files it.

There are protections against hate crimes only for the transgendered at the federal level, as part of the hate crimes law Obama signed; there are no other protections. Basically if the Good Ole Boys in Alabama kill you, the Feds will investigate it and maybe punish the people responsible, unlike their cousin Jed who is the county sheriff. It is not much, but at least it is something, and an improvement.
