I think that in the interest of fairness to McDonald's we should stop calling the burger used and instead describe it as previously enjoyed.

You are not getting off. Not putting in the trash can(or food waste container) is willful negligence and there is no way getting around it. Speechify all you want about wah wah I get minimum wage is no excuse for this type of violation of standard rule breaking. Stop justifying breaches of common sense rules and regulation. Is there evidence that someone didn't leave it on a counter in the middle of a rush and that someone else just didn't notice a forgotten burger and throw it back in the warmer? I did a year at McDonald's (And Burger King at the same time incidentally) and I learned the industry is not over saturated with talent. Isolder, is it not possible for someone to ineptly fuck up a simple task, without their necessarily have done so willfully?
Looking across the counter (no offense to anyone who's done that kind of work) I have no difficulty at all believing that some of the characters in the silly hats could do something that careless and stupid. Hell, people stupidly and ineptly do shit like fly passenger jets into mountainsides without any willfulness being involved. Seems like burger-handling could occassionally produce some fuckups, too.

I think you're giving McDonald's employees too much credit. It's one thing to say you can't justify it. Willful Negligence. Intentional performance of an unreasonable act in disregard of a known risk, making it highly probable that harm will be caused. Willful negligence usually involves a conscious indifference to the consequences. From 1-866-9-4EDGAR

I've worked in food service before. If you don't know the 'story' of a food item, you don't serve it. A big-mac box that's on the counter? You MUST ask 'Who's order is this?' and if everyone shrugs their shoulders, you throw it away.
You don't assume the stray burger is perfectly good and fair game, that's how people died. Even if it didn't have a bite, some nutbar could've put something on the burger and left it there.
There are only three possibilities:
1. Someone purposefully served a burger they knew had had a bite taken out of it.
2. They were eating their own burger in the food preparation area and it got put in the mix.
3. Someone made a conscious decision to serve a 'stray burger' without verifying where it had been.
All three possibilities require someone to make a decision to wilfully break proper procedure. If everyone is doing their job, this sort of mistake CANNOT HAPPEN.

McDonalds has a pretty high turn over, so its very possible a person was new didn't know what to do. Which would mean that they either weren't trained correctly or didn't remember.
