Arbitrary detention without charge or trial.
Interesting enough, it has precedent that goes back to a liberal administration and has precedent (As I understand) in the Supreme Court. Add on top of all that, that to qualify (can't think of a better word) for that kind of detention, one must be cateorgized as an enemy combatent. Hardly a constantly seen crime.

The point is that the integration of business and government is a hallmark of fascism. The fact that the US has a national energy policy isn't fascist; the fact tha it was drafted by business interests is fascist.

Not really. It is a hoop that previous administrations had to go through and previous courts had upheld. However, why they didn't just yank his citizenship for signing up with a foreign army (al quida) is beyond me. All sorts of legal terms can and do seem arbitrary depending on who you ask. There are nutballs on each side of the spectrum who pick and choose which ones they want to accept and which one's are 'arbitrary'.
