How not to plagiarize your Ph.D. thesis

He has long been Germany's most popular politician. But now, Defense Minister Karl-Theodor zu Guttenberg is facing trouble on several fronts. And on Wednesday, a German newspaper reported that he may have plagiarized part of his Ph.D. dissertation. Chancellor Merkel's cabinet could lose a doctor.

German Defense Minister Karl-Theodor zu Guttenberg has proven himself to be a veritable Houdini when it comes to political escape acts. When questions arose about the Defense Ministry's handling of the 2009 Kunduz air strike -- a bombing which killed several, possibly dozens, of civilians -- Guttenberg fired the head of the German military and a senior Defense Ministry official. When a scandal developed late last year surrounding the naval training ship Gorch Fock, Guttenberg relieved the captain of his duties.

This time around, however, there isn't anybody to fire. This time, Guttenberg himself has been accused of wrongdoing. According to the Munich daily Süddeutsche Zeitung, Guttenberg may have plagiarized large passages of his doctoral dissertation. And if the accusation is proven, he could be stripped of his Ph.D.

The copying concerns came to light when Andreas Fischer-Lescano, a law professor at the University of Bremen, sat down last Saturday evening to begin writing a review of Guttenberg's dissertation, which was published in 2009. He told the Süddeutsche that in reviewing works such as that by Guttenberg, he has made it a habit to plug passages into Google to check for potential problems.

When he did that last Saturday, he immediately found an article from the Swiss newspaper NZZ am Sonntag, large passages of which were to be found one-to-one in Guttenberg's work -- without citation. Further searches found other passages apparently copied-and-pasted out of other articles and sources -- some slightly altered, but most faithfully reproduced, word for word. Several pages of the 475-page work appear to have been borrowed without adequate citation.


"The text duplications can be found throughout the entire work and covering a range of subjects," Fischer-Lescano told the Süddeutsche. In several places, he says, the dissertation reveals "brazen plagiarism."


Accusations that Fischer-Lescano's sudden discovery could be politically motivated have been denied by Felix Hanschmann, a colleague and friend of Fischer-Lescano who dealt with plagiarism issues during his time as a research assistent with Germany's high court. "Neither the (center-left) Social Democrats nor the Left Party stand behind us," Hanschmann told SPIEGEL ONLINE, referring to two of Germany's main opposition parties. Accusations of political activism, he said, "don't concern me in the slightest."

Guttenberg handed in the work, a legal comparison between European attempts to formulate a constitution and the process followed by the US, in 2006 and it received top marks from the University of Bayreuth. The university has now said that it will refer the plagiarism concerns to an ombudsman who deals with concerns of substandard scholarship.

The defense minister told the Süddeutsche on Wednesday that he welcomes the move by the university to check his dissertation. "I await the results of the verification ... with equanimity," he said. "I prepared the work to the best of my ability and with a clear conscience."

Should the plagiarism concerns be proven, it is still not a given that the minister, who has long been one of Germany's most popular politicians, will lose his degree. Sloppy citation is hardly rare, and German universities have tended to show clemency in many such cases. Still, should it be shown that the copying was done knowingly, Chancellor Angela Merkel's cabinet could lose a doctor.

Of course, now it turns out he also copied the work of in-house researchers....

n May 2004, when Guttenberg was a member of parliament for the conservative Christian Social Union party, Ulrich Tammler, a civil servant in the department with two PhDs of his own, wrote an analysis for Guttenberg headlined "The Question of the Link to Faith in the US Constitution and Supreme Court Rulings on the Separation of the Church and State."

Tammler completed the 10-page document on May 13, 2004 and passed it on to Guttenberg's parliamentary office under the reference number WF III - 100/04, according to an article due to be published in SPIEGEL on Monday.

Even though members of Bundestag, or lower house of parliament, are only supposed to use of the department for work relating to their parliamentary mandate, Guttenberg included almost the entire article in his dissertation, with only minor word changes.

Tammler himself isn't cited in any of Guttenberg's footnotes. Only the parliamentary research department itself is mentioned, a footnote 83.

The 60 staff of the department are meant to help lawmakers fulfil their duties as members of parliament. The department's guidelines state: "The German Bundestag reserves all rights to the work of the Research Department. Publication and distribution require the approval of the departmental management."

Guttenberg has rejected opposition calls for him to resign but said on Friday he would temporarily relinquish his "doctor" title pending an investigation into the matter by the University of Bayreuth, which awarded him the PhD.

TL, dr: The German defence minister was awarded the equivalent of a J.S.D. by the university of Bayreuth. Turns out the work was plagiarized to a very high count (up to 80% of pages according to some claims contain dubious passages) and now one of the more prestigious universities in Germany has egg on his face. And the minister is facing possible criminal charges.

I bet most people don't understand the uproar about this. Sandbox-wars between intellectuals or some such.

If he'd stumbled over prostitutes, he'd be already out of office, despite the fact, that less harm would have been done.

Believe it or not, most people i know actually treat this as a serious issue. Granted, about two thirds of them are academics or students, but this also applies to those who are not.
Apparently, germans (at least those whom i know) actually give a damn about major academic fraud.

Fraud is the most obvious thing that comes to mind. Plagiarizing his PhD might involve other plenty of other charges if he directly relied on it to gain money and power.

Are PhD thesis subjected to plagiarism checking software, or are doctoral students' papers given more faith than undergraduate papers? (Alternatively, are the people reviewing PhD material not as tech-savvy as their lower level counter-parts?)

I don't know about nowadays, but I would have thought that this guys' PhD would have come before the widespread use of that kind of software.

He has permanently given back his doctorate (link in German)), admitting grievous mistakes, etc.

Look at his popularity to rise even more because of this - like with pretty much everything else he does ...

That is just a popularity stunt. He cannot just "give back" his doctorate. Just the university Bamberg can revoke it.
It's just another move to cling to his career. On the one hand, I would like to see him get the boot, but on the other hand he might be slick enough to somehow get through this. For how-to's look at Roland Koch and what he managed to sit out...

Well my wife being a Associate professor at the University of Wuerzburg and her Thesis wasn't subjected to many tests to verify, a few but not many.

There was an infographic in the last STERN, I think, that implied that most Germans, unlike your acquaintances, don't think this is a big deal.

Most go with the "well, I did make a mistake in my life before, so it isn't that bad"-idea and completely ignore the notion that it's more than just a mistake.
Or that it's just a campaign to destroy his career because he's so popular and such a good politician...

Yeah, if I were to do a thing like that I'd be out of a job so fast....but because he is the last great hope for the CSU and young conservatives, it must be a plot.

Though that is not the only controversial thing he has done lately, for example the stuff in the Gorch Fock affair. Did you perchance read the newest article in Spiegel about that?

It is a rather sad state of affair, when weaselling out of your own mess and outright fraud becomes acceptable behaviour for a member of the government. I especially find it galling how quickly he got rid of the "culprits" in the tanker explosion affair and with "Gorch Fock" but when he has no one to put the blame on but himself, he just tries to "stand strong".
Though that is not the only controversial thing he has done lately, for example the stuff in the Gorch Fock affair. Did you perchance read the newest article in Spiegel about that?

They weaseled out of it. They recinded his doctorate, but refused to pass judgement on whether he actually plagiarized.

I am not just happy because of his political stance (although I admit that it happening to him and to his party is an added bonus), but most importantly this shows that you CAN'T do this and expect no consequences. Wow. I really didn't expect this to happen at first - but there really was massive pressure coming from many directions - including the scientific community. Even his thesis advisor (Is that the right word - the guy who advised him when he was doing his doctorate) had withdrawn his support and criticised what he had done.

Well, this should push back his political career a couple of years. Merkel must be (secretly) happy - he was the biggest threat to her chancelorship.

But again - a great success for the scientific commmunity (though it only came about because the same failed at even allowing him to get that doctorate in the first place).

Only in the long-term.
In the short-term, this has severe impact on the elections this year as they are suddenly without their best asset so Merkel will secretly not be very happy...
