Well, you could start by immediately collecting evidence and not releasing an initial report saying the killings were justified. Then you could start by going after the lieutenant who deleted photos of the dead in order to obstruct the investigation. Charges dropped here again.

The whole list of events looks completely screwed up. And if this was anything other than American troops shooting some brown people at the other end of the world, you know they would not get off so likely. For example, imagine the above situation with Iran soldiers and US fishermen or sailors. Imagine it with Egyptian police and American civilians. Or heck, WWII Germans and French civilians. In any of these situations it would have been declared an atrocity and people would be howling for their blood. But because these are MARINES they get off scot free. Heck, the only guy they nailed was not even fired.

It is also not like there is not a pattern of similar US behavior whenever it comes to atrocities committed by their own troops.

It's not the sort of conflict where you can't afford to confiscate the rifles (to see which ones have been fired) and immediately question the troopers to ascertain who was in which house, before they can agree on ironclad stories.

Since the murders happened in a specific place at a specific time, there will be evidence left on site that, if seized quickly, might lead to convictions. Hell, if bullets are unuseable (and they very well might be, since from what I understand they tend to fragment), there's still going to be shell casings that could be matched to specific rifles.

And, of course, slam the people in charge if it can be shown they were negligent ; What happened to the idea of commanders being responsible for the conduct of their men?

But since the default for the US military is "nothing of the sort happened", the evidence got destroyed or contaminated and whoops suddenly we need to try and extract confessions from witnesses (and without the benefit of being able to say "Look, we know you fired your rifle that day.")

Still, with My Lai they just pinned it all on the commander when others were almost as culpable if not more so. I remember that many protested the guy's treatment not because they liked him but because it was clear that he was given the majority of the blame to protect others who also were involved.

The more I read about these war crimes, the more I appreciate Metal Gear Solid 4's otherwise ridiculous idea of nanomachine-controlled soldiers with nanomachine-controlled weapons. There MUST be a middle ground between "Punish the entire unit! Everyone is presumed guilty, until proven innocent!" and "Let everyone get off, scott free! No need for a criminal investigation!"
Please do not make Americans fight giant monsters.

Those gun nuts do not understand the meaning of "overkill," and will simply use weapon after weapon of mass destruction (WMD) until the monster is dead, or until they run out of weapons.

They have more WMD than there are monsters for us to fight. (More insanity here.)

They need to rework the entire mindset, which isn't going to happen anytime soon: people brought up My Lai, and the investigation into it looked almost exactly like Haditha - first everyone denied anything happened (despite the massacre being reported on the same day by Hugh Thompson, the helicopter pilot who stopped it), with only a report being requested from the commander of the unit whose men did the killing. Obviousl, the report said nothing happened.

It took a year, and a letter written by a former Charlie Company soldier to the President, the JCOS and several Congressmen to even start a proper investigation, at which point of course the evidence was gone, half the culprits were already out of the military, etc. - and even then, the denial phase continued for quite some time.

And naturally, the idea of command responsibility and "just following orders" not being a defence was eviscerated when the company's commander was cleared of any wrongdoing (despite him actively concealing the crime...) and the only person convicted was the lieutenant in charge of the 20 or so murderers. The LT got 3.5 years house arrest on base, too, depsite him personally shooting at least one wounded person in full view of Thompson.

Had the investigation been immediate and thorough, all (or most) of the culprits could have been convicted. But a lot of powerful people simply didn't want any of that, just like they didn't want it here ; The US prefers to pretend its soldiers can do no wrong, and punish them lightly if it turns out that they actually can. It would like to punish enemy leaders and officers for the conduct of their troops, while shielding their own leaders and officers from any responsibility.

The US military must simply acknowledge that 150 minutes of lectures about the geneva convention and rules of conduct isn't enough to prevent war crimes. It must decide: does it want its soldiers to have a conscience, and refuse unlawful orders and report such incidents (in which case you need to press this issue all the time during training, and treat reports of atrocity seriously so that the chain of command actually acts on them), or does it want its soldiers to obey all orders, but hold the officers accountable (in which case you need a high caliber of officer even for simple lieutenants, so that you can count on them keeping their troops disciplined)?

The mentality of "deny, cover up, wait it out" is what causes these breaches of justice, but nobody really wants it to go. The commanders like the idea they cannot be held accountable for the behavior of their officers, the troops don't feel the obligation to act against their officers when they give an unlawful order, and the public enjoys the illusion that American troops are such good people that they just don't do war crimes.

My Lai happened decades ago, and America's like filled the rest of the decades between then and now with a whole bunch of other wars perhaps with their own fair share of great patriotic American freedomizations of treacherous civilians who cheat and hide their guns like the punishment-deserving cowards they are. Has much changed since then when it comes to the big government socialist protocols of communist-sympathizing liberals persecuting our true blue boys who are just doing their god-mandated job of eneagling and bringing democracy to all the Charlies and Ackmeds in those mudhole jungles and shithole deserts? With the amount of change between now and then, we can determine just how much these great United States actually care about changing anything at all. PeZook nails it spot on in every regard.

Furthermore, it should be added that the numerous highly publicized incidents where the troops have gotten away with murder or a few scapegoats at most have received ridiculously light punishments have significantly contributed to a culture of impunity among US troops. If and when such stuff does gain the public eye and the troops see that there are no consequences, they will know that short of committing the crimes on camera AND that material becoming public, nothing will happen to them.

If you've already got documented cases where domestic law enforcement covers up brutalities and the like against their own citizens, then how much more in the case of the military and their actions against detestable foreign people who they were sent to that country to kill in the first place?

This great nation is right, it's true, and it is great. It can and will and has and will continue to destroy any and all enemies who stand against it, foreign and domestic. Look at within its own territories. Brutalities are inflicted on their own disobedient countrymen. The powers that be allow this, they even help perpetuate conditions that bring about misery and impoverishment to their own fellow men, and they let this continue on. They enable this, they benefit from this, they are made more powerful and more right and great by this.

If they are capable of doing this to their own people, then imagine just what they can do to people who aren't even from the same nation as them - people from halfway around the world, who are different, and who they have sworn loudly and cursed quietly in screeds of pleasant euphemisms to destroy. If in their scheme of things, they don't even care for the plight of their own countrymen, do you think they'll even give a second's glance at these outsiders?

I think the only surprise here is the surprise we have that this has happened. We should've know. We all should've known. Those Iraqis didn't have a chance. They never did. The second the first American soldier set foot on that damned nation, all those people were already dead.

We might be getting some more information about the case soon, as Anonymous says they have taken a shot at the law firm that defended the Sergeant and stolen 3 GB of emails belonging to the partners. link
