Rights are not derived from the law. If they were, no one's rights could be considered violated by the regime in any given genocidal dictatorship, because the government says it is completely legal for the government to do what it's doing. Rights-based ethics presume that rights are fundamental to humanity, sapience, are God-given, or some other measure that roughly encompasses the human species, not that they are arbitrarily granted by the same law that they are supposed to be a shield against.
The basic reason for having gender separated facilities is to reduce the risk of assault & harassment. It seems clear that the risks for mid-transition M-to-F transexuals is lower when using female facilities vs male ones, while the increase in assault risk for existing users is negligible, hence there is a compelling argument that transitioning trans-women should be allowed (but not required) to use them. Regardless of medical specific I would be inclined to be lenient with anyone undergoing a gender transition given all the undeserved difficulties and risks it entails. That said obviously 'identifies as (gender)' must equate to something much stronger than 'yeah, I've decided I'm a woman today' for the concept of gender-separated facilities to make any sense. I am pretty sure this is a solved problem although political correctness campaigners do sometimes go overboard with the rhetoric and make it sound like they will take anything people say at face value.

You know, this sort of hysterical over-reaction to violations of strict change-room gender segregation is not the exclusive province of transsexuals.
Anyone with small children who goes to a public swimming pool has run into it as well. I've seen women plaintively asking strangers if they've seen a little boy in the change-room matching a certain description, because they're not allowed to go in to look for him and he's too old to be allowed into the womens' change-room with her. It's ridiculous.

Of course that would massively offend all the bigots, but who cares? Might as well start educating people in college about the little fact that gender isn't a dualistic, firm dichotomy.
Or just go with non-separated bathroom facilities, or one room for urinals and one for toilets.

About once a year, a bunch of freshman girls would get together to announce that boys are gross, demand separate-but-equal bathrooms, and get hilariously slapped down for their bigotry, but nobody ever complained about gender identity conflicts.

Not that I am defending the parents in this case, but in all honesty I have no idea what someone who is transitioning would look like. It just isn't something I have come across, and there's only so much that can be imparted by text descriptions. Academically, I know what the effects of hormone treatment are, but that doesn't necessarily mean I would instantly recognize it. It would probably take me a little while to work it out.
