That only works if the EULA is enforceable. Which varies from one jurisdiction to another.

Pretty sure for foreign companies, if they violate our laws and refuse to show up in court, they only lose the ability to sell their products in the US.

Which seems pretty likely.

I'm not questioning how bad it will be for the WarZ team if this gets into court. I'm just doubting that anyone with standing will care enough to bring it into court.

The only way they end up in court (or a US proxy does) is if the leaks/rumours about it being a planned scam of pull in money they never intended to let the players use are confirmed.

Class action, there's money to possibly be made here and a class action suit where they can get a few thousand people to sign up means a few million for the lawyers involved and 2.4$ per person affected.

That sort of thing is almost certainly illegal and so it doesn't really matter what the EULA or TOS say you've waived.

The people who bought it through Steam can get their refunds from Valve. So I don't see how Steam's TOS matters when Valve is making Steam customers whole.

Only between Valve and its customers. The agreement doesn't say diddly about third parties that might happen to use Steam, as far as I can tell.
