Lots of Drama in Texas Tonight (SB5)

Post by Prannon »

Ok, so I only just learned of this tonight, but apparently, there was a whole lot of drama over a bill being debated in the Texas Senate tonight. Bill was called SB5, and was controversial for good reason. See article below:
Texas Lawmaker Braving Backbreaking Filibuster to Stop Abortion Bill
The only thing left standing between Texas and one of the strictest anti-abortion bills in America is State Senator Wendy Davis.

Literally: Davis, a Fort Worth Democrat, is nearly three hours into a 13-hour filibuster intended to derail a Republican effort to pass a law that would "virtually ban" abortion in Texas, according to Planned Parenthood Action Fund president Cecile Richards.

NBC DFW explains:

[SB 5] would ban abortion after 20 weeks of pregnancy and force many clinics that perform the procedure to upgrade their facilities and be classified as ambulatory surgical centers. Also, doctors would be required to have admitting privileges at a hospital within 30 miles — a tall order in rural communities.
According to Choice USA, if the bill passes, "all but 5 abortion clinics [out of 47] in the entire state would be forced to close their doors."

A Texas House version of the bill passed on Sunday after some stalling on the part of Democrats to try and keep the bill out of Senate hands until Monday.

This allowed Senate Democrats to pull a few delaying tactics of their own in order to prevent Republicans from voting on the measure before Tuesday morning.

Today, around 11 AM, Sen. Davis began a filibuster that must last until the special session ends tonight at midnight in order to ensure the bill's demise.

This will be no easy task: Senate rules require all filibustering lawmakers to remain standing for the entire duration of their speech — forbidding them from so much as leaning against a desk.

Davis is allowed to take questions from fellow Democrats, giving her time to rest her voice, but can't leave the podium for any reason.

To ensure she had sufficient material to speak for 13 hours straight, Davis asked women who have undergone abortions to send her their story "so I can tell it from the Senate floor."

To put into perspective the kind of mindset Davis is up against, the bill's sponsor, Rep. Jodie Laubenberg (R), believes putting an exemption in the law for victims of rape and incest is unnecessary because these women have already been "cleaned out" by emergency room "rape kits."
Once I heard about it, I tuned in out of curiousity and was quickly enraptured by the whole proceedings. Basically, delay after delay after delay, up to the wire. And even after midnight rolled around, it was hard to tell if the vote occurred or if it didn't. Even now, no one really knows what went down.

Starting this thread to keep tabs on the topic.

From the video livestream, the vote happened after midnight but got backdated to have taken place at 11:59. Currently the confusion is over whether you can retroactively backdate it like that if there's enough "disruption" in the session. I say confusion, but it should be obvious who's going to be pushing which interpretation.

It also ended with many onlookers being arrested for causing said "disruption".

Edit: If it's not clear, the livestream watching the session had over 100 thousand viewers witnessing it, let alone the people in the room, but they're still editing the records to show that it happened at a different time than everyone saw.

Have I mentioned we need to reoccupy Texas with federal troops? They obviously cannot handle running their own state.

Among most of us Texas Democrats, there are calls for Wendy Davis to run as Governor or some other high public office.

Texas Democratic Party chair: Sen. Wendy Davis should run for governor

Gilberto Hinojosa, chairman of the Texas Democratic Party, said he hopes that Sen. Wendy Davis (d), who conducted a 10-hour filibuster against a bill that would close all but five abortion clinics in the state and ban all abortions after 20 weeks, will run for statewide office. Speaking to Raw Story from the Texas Capitol on Tuesday night, Hinojosa said she would likely win a bid for the governor’s office thanks to her marathon filibuster.

“I’m so proud of her effort and what she’s showed Texas,” Hinojosa said. “Women deserve, in this state, to be treated with dignity. I think that she’s taken it to the Republicans in a way that was not expected. She has put them to shame and made us all very, very, very proud.”

Asked about her potential political future, Hinojosa cracked a wide grin. “Wendy is not only extremely intelligent and articulate, she’s great on the issues and she’s got a great personal story — a single mother who made it out of a life of poverty to go to Harvard law school, then gets elected to the city council and the Texas Senate by beating an incumbent Republican,” he said. “She is someone that can really, really excite people across the state of Texas, who really shows true leadership.”

“She doesn’t play games or worry about what’s going to get her votes,” Hinojosa continued. “She does what she believes is right. We’ve been sorely lacking that kind of leadership in the state of Texas for more than 20 years. So, yeah. I’m hoping she runs for statewide office, and I know that should she decide to, all of these women and men that are here today, young and old, will work their hearts out for her. She’d probably get elected governor, or whatever other office she wants to run for.”

Davis’s filibuster unceremoniously ended just after 10 p.m. CST when Republicans cited her on a third “point of order” for allegedly going off-topic by mentioning Planned Parenthood in her filibuster of S.B. 5. At the time of this writing, fellow Texas Democrats were pulling out all the stops to block a full vote on S.B. 5 by using arcane parliamentary tactics to delay until midnight, when the special session officially ends.

S.B. 5 would ban all abortions after 20 weeks of pregnancy — well before medical experts say a fetus is viable outside the womb — and force all but five of the abortion clinics in Texas to shut their doors by 2014.

If they succeed, it’s still possible that the bill could come up again in the days to follow if Gov. Rick Perry (R) decides to call another special session, which he could do tomorrow if he desires. Perry initially placed the anti-abortion measure on the legislature’s docket as an “emergency” provision, and said at the time he would like to see the right to abortion completely revoked in the state.

It passed, but there was a problem with the parliamentary procedure. About 50 minutes ago (as of this posting), the Lt. Gov ruled that the session ended before passage and the bill is dead.

I suggest simply outlawing pregnancy from rape. It is the most elegant solution!

Next step: outlawing cancer.

This is a long standing pet peeve of mine because it's misunderstanding this adage.

The original context is of course if we outlaw guns only criminals will own guns. Most people (falsely) take this to mean that only criminals will own and use guns. This is not what it's trying to say. What it is saying is that if you take some formally legal activity/belief/item and make it illegal, those committed to that activity/belief/item will become criminals.

Thus if you outlaw cancer... you turn all cancer patents into criminals.
Which is what makes PeZook comment so sad because that is the law in some countries. How many weeks has it been since some Arab country put a women to death for being raped and getting pregnant? I bet you it's not been more than five weeks.

Could you cite the origins of this? Because I would have sworn up and down that it was meant to say "If you make owning guns a crime, only criminals will have guns, and everyone else will be defenseless." The italicized passage being implied.

Say? How about trying to alter database entries in their fancy proceeding tracking system while a hundred thousand people are watching?

EDIT: BTW, isn't it awesome how a politician involved in a women's reproductive health bill doesn't know what a rape kit is, while some fuckface from halfway across the world (me) does?

Rape kits are basically unknown in Poland and not really used. I learned about them like five seconds after starting to read up on women's health and sexual assault issues in the US though.

See there's your problem. That's a fundamentally UN-American attitude. Why spend five seconds reading up on it when you can spend an hour having your ideas reinforced by watching Fox News?

+1 for the woman going on to prominent office, a filibuster is a lot harder than it sounds in principle, and she was willing to stand for several hours on her beliefs.

I wish I could say I was amazed to hear of a man, an elected official partaking in this debate no less, thinking a rape kit is something that magically makes pregnancy go away without an abortion. As opposed to, say, a kit for gathering evidence to identify the rapist. But I'm not. This is sadly typical of government in many parts of the country.

The contributions of Senator Van de Putte shouldn't be overlooked, either. She left her own father's funeral to get to this session in time to make a difference, and she had Davis's back from all the attempts to shut her down, and the "citizen's filibuster" at the end that kept the vote from being called before midnight was prompted by her actions, too.

Davis's filibuster should get mentioned for how crazy it had to get, too. You hear of filibusters where the person starts reading from the phonebook or things like that, but not only did Davis have to stay entirely on topic to the point where the Republicans tried to stop her filibuster several times for that, but they also tried to shut it down because someone helped adjust the back brace she needs to stand straight.
