Richard Thomas was sentenced to five years and four months after admitting raping the woman at her home in Leigh, Greater Manchester.

He knew she was ill but did not know she had HIV and collapsed when police told him, Liverpool Crown Court heard.

Thomas, 27, of Sandringham Drive, Leigh, raped the woman after she had taken a sleeping tablet.

A perverse result could be that there may be less reported rapes, as less victims of family members come forward, unwilling to have someone they know given a life sentence.

Besides which, after rape it is possible for someone to have a happy and fulfilling life, something that is not possible by definition after murder.

Depends. Different people are different. He may not have seen what he was doing as rape, if there was no physical force involved. She wasn't being harmed, so no problem, right? (his thoughts may have gone). So he might see endangering people with a lethal disease as bad, or again, he might not care.
You'd really have to know the individual.

That's quite misinformed. Besides the fact that the disease has a significative latency stage, assuming that he gets treatment it is eminently likely that he'll be released well before dying from AIDS, if that ever happens.

With retroviral medications, HIV infection is now a chronic disease like say renal failure or COPD. You're going to die of it, it has an impact on your expected life expectancy, it makes you're vulnerable to lots of shit, but the onset to AIDs can be effectively delayed.

In fact, if he stays consistent with modern HIV drugs (which is very easy to do these days since it's generally only a 1-pill a day regimen), his life expectancy won't really drop at all. It'll be like he never had it in the first place.

Actually, it's not whether or not she has AIDS but whether or not her viral load is high enough for transmission to be more probable. However, if she's consistently on meds, then her viral load would be very low and it would be very difficult for her to transmit HIV even if she tried to.

Likewise, someone in "full blown AIDS" might be less contagious than someone not yet showing symptoms. In the later stages the T-cells are so depleted the viral load drops due to lack of host cells.

While I'd like to think this would scare the guy into not raping any more likely all it will do is make him more careful about his choice of victims.

Assuming he gets HIV meds while in prison, though I doubt he's be denied them while in there. Reminds me of a case I read about where a guy in Canada (I think) with HIV knowingly slept with and infected two women, both of whom subsequently died from AIDS and he was imprisoned for life.
Can't help but think it in his case it would be justice to deny him HIV medication and allow him to die in the same way his victims did, though that would probably qualify as cruel and unusual punishment.

Which suggests the perfect punishment for his crime. In all but destroying a woman's life by being a subhuman animal, he doesn't get the medical treatments that would otherwise keep him alive.
