Story
When Ray Friesen heard his wife screaming, he struggled free of his binding and got a pistol, said Sheriff John Armer.

Friesen found his wife bleeding and the suspect standing over her with a knife, Armer said. Friesen shot several times.
God created man, and Sam Colt made them equal.

Without that pistol, I have no doubt that Mr. Friesen would have joined his wife in death. I just hope no fuzzy headed liberal DA tries to charge him with anything.

But I think he only made them equal at not less than say 2m and not above about 7m. At somewhere below 2m, if the other guy's fast, he might just run over and grab the gun or stab you - a desperation move, but if you did it fast and decisively plus you are strong (especially if it turns out the gunner wasn't THAT ready to just put two in him,) I've been told it might work.

At above 7 or so meters, marksmanship begins to come into play more if both guys have a gun. The stronger guy still also has something of an advantage because he can handle a more powerful gun. Bullet placement is the #1 factor, but I'm sure a hit with say a .40S&W hollowpoint would work a good bit better than a .25ACP BALL, other factors being roughly equal :D

Seriously, though, while I haven't had a position yet on the gun issue (I think the dynamics of your country influences it) I would agree that the gun was probably the only chance the man had. To him, the gun was a godsend.

As long as his story and the evidence check out and it doesn't look like he took advantage of the stranger being there and staged the whole thing to get rid of his wife I think he should be okay.

Then he'll just have to deal with his wife being killed. :|
