The horror of a low level paper pusher doing his job because he needs it. Most government employees don't have the luxury of making some dramatic political stand every time a little quibble happens. Take it up with the courts or the officials in charge. Now for clarification I am NOT trying to equate what this couple did with any of those things but it is the same mentality. Just because you are looking for terrorists doesn't mean you stop enforcing the rest of the United States Code regarding immigration and issuance of visas.

I would like to know if there is a specific section of the code which explicitly instructs Customs agents to force gay married couples from another country to enter as separate individuals.
Quite frankly, I find it highly doubtful that the regs are clear about what should be done in this case, and I strongly suspect that the Customs officer in question took some "initiative" in deciding to interpret the regs in the manner which would cause the most possible inconvenience for this couple.

1) The US does not recognize gay marriages.
2) if you aren't married and aren't related by blood then you aren't a legal family.
3) if you aren't a family you can't file for entrance as one.
Sure the guy might have fudged it but then he would be in the wrong technically (if not morally because I disagree with the position in general). I personally say don't blame the guy for following the letter of his regs even if you believe their spirit would be a better guide.

Customs policy is not my forte, as I'm sure you can imagine, but yeah, I would assume so, since it would be a heterosexual marriage and he wouldn't be trying to enter America as a polygamist.
