Who's right?

This could actually go a few places, but my best bet is here.

So I need to know who is right...

This is the Fair Use Copyright Law (Section 107).

This is some stupidass on DeviantArt who says that my gallery (here) is in violation of the DeviantArt Terms of Service (here and here) and the FAQs.

So now I've been reported to the staff who want me to take stuff down.. and I want to know truthfully.. who is right and who is wrong..? I believe that I am in the right.

The PSD images that I used to create those layouts were up on sites that specifically have PSDs for others' use!

From what I understand, you are in the right. The guy "mirrorkills"(sp?), is just a semantic loser who has no friends and hates everyone. Plus he just wants to cause misery to others.

I'm no lawyer, but I believe you're in the right.

Of course they also have the right to decide what goes on under their aegis so there's not much you can do in the end. It's their site and their call.

Ok cool thanks. It's somewhat resolved, so I'm going to credit the places where I got the PSDs from, but I wish I didn't have to. I hate making "communities" happy.
