Canada, however, is preparing for its 1 million-strong Muslim minority to be under the authority of a Sharia system enforced by the Canadian court system, according to the Canadian Law Times.

Muslim delegates at a conference in Etobicoke, Ont., in October elected a 30-member council to establish the Islamic Institute of Civil Justice.

It looks like all that has happened is that some Canadian Muslims got together and said that they wanted to do this. I can't see that it's the slightest bit legally binding.

I came across another article today, and it looks like this may be legally binding after all.

The assembled Muslims (one of whom was actually a woman) heard that under recent amendments, the rulings of an arbitrator can no longer be appealed to the courts. Decisions by the new Muslim arbitration tribunal will therefore be final.

Provincial arbitration statutes allow disputing private parties to choose a mutually acceptable government-licensed arbitrator, instead of suing in court and spending their life's savings on lawyers.

The purpose of arbitration is lost, however, if the losing side can go to court with an appeal. For the system to work, the arbitration process must be (a) acceptable to both sides, and (b) final.

The obvious danger of a sharia arbitration system is it will not be voluntary. A Muslim who opts for a secular court instead of the local kangaroo arbitrator would be expelled from the Muslim community. If you are a newly arrived mother who can't speak English and can't make a living, how realistic is this?

This is worrisome. The article went on to say, though, that the problem could be avoided by forcing the arbritrator "to apply Canadian legal principles and value, not [Muslim] ones."
