Virginia Arrests Man for Spam Email Under New Law

DULLES, Va. (Reuters) - Virginia authorities said on Thursday they had arrested and charged a North Carolina man for sending "spam" e-mail in the first use of a new state law that could bring penalties of up to 20 years in prison.

Virginia Attorney General Jerry Kilgore said Jeremy Jaynes had been arrested earlier Thursday in Raleigh, N.C., on four counts of using fraudulent means to transmit spam.

Kilgore told a news conference that officials were in negotiations for the surrender of a second man, Richard Rutowski, on the same charges.

Jaynes was charged with violating limits on the number of messages a marketer can send and falsifying routing information, both illegal under the Virginia law that carries penalties of 1-5 years in prison on each count.

Although based in North Carolina, Virginia is asserting jurisdiction over Jaynes because he sent messages through computers located in the state.

Roughly 50 percent of the world's Internet traffic passes through Virginia, home to big Internet companies like Time Warner Inc.'s (TWX) American Online unit and MCI (WCOEQ.PK).

Spam has grown from a minor annoyance to a major threat to the stability of the Internet, experts say, and now makes up more than half of all e-mail traffic, according to several surveys.

"These criminals are harming businesses in Virginia, and that concerns us," Kilgore told the news conference at AOL headquarters in Dulles, Va.

1-5 years on each count, meaning he can get anywhere from 4 to 20 years if hes convicted for all counts.

I say you lock him up and sentence him to have no contact with the outside world except through email, then sign that email address up for every spam list possible, and make him suffer the same things he did to so many others.

Hang on people, they just got charged. No convictions as of yet. Also, I really doubt they'll do the full 20 years; no one ever did the full stretch for mail fraud now did they? Although I suppose since they are testing it out, the DA might be interested in making an example in which case it is certainly possible to see a long prison sentence.

On a more personal note...OH YEAH!!!!!

A little background in US law here folks.
Usualy, when multiple convictions are for the same crime, or the same sentance length, the terms are run CONCURENNTLY.
Only the most heinous of crimes get CONSECUTIVE terms.

If you are convicted of,
Burglery, 2 years,
breaking and entering, 2 years,
posesson of burglerey tools, 1 year,
assault, during the comission of a crime,+2 "enhancement"
and Assault with intention to comit grievous bodily harm, 3 years,

your time behind bars will NOT be 10 years, it will be 5 years.
3 for the longest, and 2 years on the enhancment, = 5- time off for good behaviour.
This man faces no more jail time than the length of the single longest term, not all of it put together end to end!

5 years is the longest this guy could POSSIBLY spend behind bars, less time off, if he gets the maximum.
If he plea bargains, he will probably get 18 months to 2 years, if he makes the state go through the trouble of a trial, he will get the maximum.
Still, think about it.
2 years!
It doesn't sound like much at first, but, hey how long would 2 years feel to you folks?
The simple fact of even 90 days will scare the bejesus out of most of these scum. The people who do this are NOT the streetwise violent kind that detox, heal/fatten/bulk up in their home away from home, and are scared of the ones who are at home in jail.
It's like they keep sticking their dicks into a hole in the fence, and once in a 1000, they get a rightious blowjob. As long as nothing bad happened, there was no reason not to. Nothing ventured, nothing gained, goes the saying.
Well, now there has been a savage dick biting, and sticking your wanker ino the hole now has a new risk that wasn't there before!
How bad do you want that blowjob now? Is it worth the risk of a dental circumsision? :lol: :shock:
